Topic: Any July 2nd filers getting RFE yet?

I filled during the rush on July 2nd but didn't include medicals as I didn't have them completed in time. My Lawyer said I should wait until we get RFE before sending medicals as there is a possibility they could get lost. I know there are many peopel who sent their I485 without medicals and I'm wondering july filers have been getting RFE for medicals yet?

FP - 10/5/07

Topic: I-485 Receipt Notices Will Now Take 90 days

According to Customer Service Representatives at the USCIS, receipt notices for I-485 cases will now take 90 days to process from the time of delivery to the respective service center. Contrary to the latest press release posted 8/24/2007 on "Service Center Receipting Update", it will take 90 days due to the huge influx of cases received.

Here is the USCIS answers to the questions about when you can file if you labor cert is approved before July 31 or after August 1st. Look at questions/answers to 10 & 11. Look slike it all depens of the priority date.

I think i need to clarify, my attorney filed after the BIG annoucement on July 2 (no more GC available). So she sent out the paperwork thinking it would be returned. As for the medicals, she did not sent them out just in case they got lost when INS returned my paperwork.

After the fiasco of July 2nd when the USCIS decided to change the bulletin our lawyer still mailed our documents with the intension of getting a refusal from them so we could join the lawsuit against them. Now with the upcoming changes and accepting of petitions I am now worried that they will deny our application because our medicals where not included. We received our medicals days after submittal and can submit if they request.

My questions:

1) Will they outright deny our I-485 application?
2) Will they return it and have us reapply with the medicals? (this causes a problem because we are not sure how long it will take for them to return and if our date will be current by then).
3) Will they simply send an RFE for medicals?

Has anyone sent in their I-485 application without medicals? What was the outcome?
