First I140 - Not revoked. with Priority date (01012010)
Second I140 - Revoked - So your I410 is carry fwded.

I saw few friends same situations. You can still use First I140 for VISA extenstion if not revoked.Also priority date will be the first I140's.

Note: in case your I140 is revoked based on Fraud and illegal activity. then Nothing.

Every company has to be ready to reply USCIS .
How many GC process are in current?

Lets say Desi company has 50 employees working.
Guess how many GC process will be in line every year? It could be 30 , 40 ,45?
If employee leaves the company it will be not company's fault. Right?
So employer will not care for person leaving the company. So he will update USCIS and try to reduce the count.

This way he can apply more GC for people who are working for him currently.
If he is still holding - He has to answer USCIS. why he is still holding. Future employment is different story.

If it is Client , They will follow certain process and update uscis.

Regarding money - No answer from my side.

If you have income. You can run pay roll. If there is no income no need to run pay roll.
At end of year you need to show, your total 12 months(it could be 5 months 7 months no pay roll) and file taxes.

"In case of travel to client place or any other expenses, I have to bear it and not my W2 employer. I was told that some of these can be put onto company's expenses; thereby, there may be more savings for me. Not sure if this makes sense to you, any thoughts? "

Ans - You are the independent working right and You have income directly from people/companies/Client. is it Correct?
If you are working for your own company.While filing taxes, you can claim all your travel expenses that you spent for traveling through your company.

You can start your own company on H4 -EAD. But you need to make sure your company type.
You can make home as company address.


Just some more information that helps you...

It all depends on nature of work, Money inflow outflow should be transparent.
Depends on State you are living.

Nature of work - If you show company as consulting firm and hire neighbors as nanny/care takers. This will not work.
Money inflow and outflow - Should always be ready what is source of company and How much balance you are holding in company? Expenses in the company account.All the money in your company account will not be yours it has to transfer out into your account as pay roll or expenses.

Depends on state - Each company differs with state laws on starting companies. Your local lawyers will help on this.
Get in touch with Tax consultant every year. There could be a lot in saving tax. Also you can always be on safe side with company transactions.



Overall --- Starting company is very simple. But with lot of legal things to be followed.


Also Just example - Client - Prime Vendor -- You company .. So all money matters is How much your getting from prime vendor to your company account.How much you are running pay roll for yourself from company's account.
Also it could be just you as single employee or multiple people working for you getting paid.

A is correct.
As far as I know Priority date porting will be considered only while filing I140. So when company B is filing your I140.
But again please get this confirmed.

I am very pleased to report this morning that I saw a news report from USCIS Nebraska Service Center teleconference on April 12, 2012, that clarified you can carry forward the Priority Date from one I-140 approval to another 1-140 approval for another employer, even if the old employer revokes the I-140. USCIS has flip-flopped on this issue several times.



Let me first bring you to the news. Right here it says. If you look at the question number two. The answer is, both centers adhere to retaining the earlier priority date, unless the I-140 was revoked for fraud or willful misrepresentation. So the idea here is this: even if you go from Employer A to Employer B, and Employer A revokes the I-140 approval, the Priority Date is yours to carry forward to any employer you like--B,C,D,E--unless the employer A’s I- 140 was revoked for fraud or misrepresentation.



The history of this interpretation is strange. A few years ago, this was the position. USCIS always said you can carry the Priority Date forward. A couple of years ago, they started saying, “No, you cannot.” We had several cases in which they raised this issue, so anybody who has had this issue decided against them can actually go back and file a motion to reopen/reconsider. I advise you to think about this very carefully. You could actually go back and ask USCIS for the Priority Date to be carried forward if they had earlier denied it. There’s a whole lot of people who went through this. File a motion to reconsider. Then USCIS started saying, “Well, you cannot do it.”



Now they are back to their old, very good interpretation, which is in line with Congressional intention for AC-21, where Congress wanted to create room for people to leave their jobs and move on to other jobs because Green Cards were taking so long. So Congress said, “We’ll put in AC-21.” That will make it easier for employees to change jobs without losing their Green Card benefits.



This is excellent news, folks. Once again, I am summarizing it for you. You can carry your Priority Date forward, even if the old I-140 is revoked, unless the I-140 is revoked for some fraud or some willful misinterpretation.

As per Attorney,

If withdrawn, you can always use priority date.

If revoked under fraud - you cannot use priority date. Employer and USCIS can decide reasons for revoking I140.

Again If employer updates uscis to withdraw, there are some cases status still shown as revoked. This could be any reason. But USCIS will always provide a document/explanation for revoke. Based on this if not fraud or no illegal or no cheating.

You can still use your priority date. So in this case it will be depended on your employer and uscis.

Again this is only information I got.

Here is the answer I got from attorney.

After you change employer. You can always keep tracking your I140 case online. I am sure you know this.

Two scenarios : One withdraw or Revoke.

If you change employer and if employer withdraws your I140. - You can still hold priority date. pretty straight answer.


If you change employer and if employer/uscis revokes your I140. There could be reason fraud on your I140 processing. So revoked. This you cannot use priority date further.

Under revoke story again - you may see revoke status on https://egov.uscis.gov/casestatus/landing.do USCIS will send you mail/email stating proper reason for revoke. Behind it could be withdraw from employer but still revoke status may be displayed on website.

So better know proper reason for revoke and proceed.


Again, one more point. If you change employer immediately after I140 approval. Not better idea. 365 days after I140 approval employer cannot revoke stating fraud. Some common sense applied here :) . Hope this helps.

Could someone please help me out with my situation?

My Situation :

I worked with Company A. They initiated my Green Card process. After PERM approval. I Left the company. So they cancelled my PERM.

I joined company B. They initiated my Green Card and I got PERM and I-140 approval in June 2013.

In between my previous Company A agreed to process my Green Card as future employment.Now PERM is approved and I140 was filed in February 2015. Case still pending.

Note . My H1-B duration with Company A and Company B is 6 years completed.I am in 7th year.
My H1B is still valid till October 2016. At present I am still working with company B.


Now because of my family reasons. I need to change location. I got new offer and want to accept it. This will be my Company C(Full time with Client). They agreed to start my green card within 3-6 months.

I am sure company B will withdraw my I140.

Questions :

Can I hold multiple I140 s with Company A and also Company C?

Just in case, if for some reason if my H1B transfer fails/rejected.
Can I still go back and work with company A or any other company?

Will there be any legal issues in my situation?

Correct if your PERM is approved. You still have 365 added to your stay in the US. Employer has to share I140 details. If not you can always put employers name here so some others will not fall in trap.
