with whatever has been going on it would be a decade probably (assuming the bailout works) before US sees some growth in their economy again; & if it does not work, this is the end of the economic hegemony of the US, forever.
try Europe, China, Australia, middle-east, far-east or even South Africa; alternatives look much better elsewhere.
Problem with India is its per capita GDP is very little, very polluted cities, & no one says 'God Bless' when I sneeze! |

1) I have over 5 yrs of experience before joining current company -- req'd
2) My 9089 says Bacheolors required in CS, Engineering or Electronics -- ok
3) point 8 in 9089 says Alternate combination of education and experience is acceptable? -- irrelevant; many of my friends got approved with the same, mine got denied; this is acceptable for job offer & EB3 as skilled worker not for EB2
4) point 14 says ***Any Suitable combinatio of education, training or experience is acceptable*** -- same as above
5) I have 3 yrs Bachelors in Electronics and 2 years International Business Masters, My education evaluation says Bachelors in Electronics and Business administration duel major -- great; this should make you eligible with #1

B1 VISA is not a dual intent VISA; your brother's wife needs to apply a V Visa;
The moment an AOS is filed this will invalidate her of her B1 visa.

if your wife has been using EAD to work somewhere & receiving salary, she loses her H4 status; if she did voluntary work or if she just had EAD she would not have; her H4 will get automatically denied when you tick the box in I539 that she has worked & would have to apply for her H4 by doing stamping & entring USA; she cannot work & get paid for it & eyt keep her H4 valid.
You may chose to keep your H1; working in EAD does not invalidate your H1. |

category is chosen by your employer when he files for I140 based on the labor he filed for you.
you labor may require BS+5, but it is upto your employer to file you in EB2 or EB3 in your I140. You have to mark 'advanced degree' or 'skilled professional' etc. in I140 which will determine your category.
pls ask for your labor details as you may require it later if you plan to change after I140 gets approved. |

I do not think so; you can not have 2 outstanding I140 simultaneously in same EB category; if 1 has been denied, you can have another, but not at the same time; you can however have 2 outstanding in 2 different categoriees |
