Topic: Biometric Backlog?


Four months after submitting my I-765, I-131, I-140 and I-485 in the EB2 category, I still haven't been called for fingerprinting. I notice that most people get called within a month of their I-485 notice date. What makes it stranger is that my I-765, I-131 and I-140 have all now been approved before any request for fingerprinting. Is this normal?



This is fine. Biometrics can be done at any stage in the process. There are even cases where the Biometrics are done last.


I called TSC to check and they said that my local field office (Boston) is facing a 6-month backlog for FP. Has this been anyone elses experience, and do I have any other option to get my FP done and get this application moving forward?


You could probably try calling the Manchester, NH ASC to see if you can do your Biometrics there. Its about 45 minutes north of Boston on I-93.

7.July filer. Delay was due to increase in applications.

14.Attorney stayed on top of case. From H1 renewals to I-485 applications. They always contacted us when it was time for us to renew visas. Never had to worry about anything.
15. Wife is still with filing company. Not planning on going anywhere.

Topic: I-140 approved. Lawyer says I don't need I-485 AOS.

Remember that the I-140 process is just another step in the Employment Based Green Card process. It just says that the employers petition for a foreign national has been approved. However, you are still on your H1 and you have NOT attained the LPR status yet. You will need to do the final step which is the I-485 AOS to complete the process. Therefore, when your H1 expires, you will have to renew it. My humble suggestion is to find another lawyer.
As for your family, the I-485 stage is where they are added to your case. ie. You will fill out I-485's for them as well as derivative benificiaries.

You are soo close. Why would you risk adding unnecessary delays to your application. I would suggest that you stay right where you are.
