Topic: 3 CRIS emails, how many items sent in mail?

Two things are important in the order listed below:

1) Physical Green Card (It normally comes with the welcome notice as it is snapped into the white welcome notice)
2) Approval Notice on I-797 Form (Green Form just like H1B I-797 approval notice)

I only got the approval notice e-mail from CRIS. No welcome notice or CPO e-mail. However, within 3 days of receiving the approval notice e-mail, I got two mail letters from USCIS: One containing Approval Notice (I-797 form) and the 2nd one containing green card snapped into the white welcome notice.

Not getting a CPO e-mail doesn't mean anything. As long as you get either one of the the 3 e-mails (CPO, welcome notice or approval notice), you are approved. I also know cases where ppl didn't get any of these e-mails before getting the physical green card in the mail.

My suggestion would be to contact a good immigration lawyer (consulation fee etc.) and discuss your situation in detail. If the lawyer suggests that you are Ok if you report ABC to DOL, I would suggest go ahead and screw this nasty ABC (dinky company) who is exploiting a lot of indians who come here in different forms and shapes

Topic: AC 21 Portability

Folks AC21 has been beaten to death so many times that I have to write this post (not a legal advice ,,, just my 2 cents)

Pros of AC21:

1) It is not required by law to file AC21 but USCIS suggests to notify them (and so does many attorneys) when you change jobs (employment based I485)

2) Half peace of mind that in case your x-employer withdraws I-140, you may or may not get RFE or NOID or Denial. You will definitely get a RFE/NOID/Denial in case your x-employer withdraws and you didn't file AC21. But with AC21 filing, you May or May Not get any RFE/NOID/Denial depending if your AC21 documents reaches your I-485 file. I heard in many cases that it gets lost in the mail room etc., and doesn't get tied to the 485 file.

3) It is in the citizenship manual that IO is supposed to ask you about the sponsoring employer (the one on I-140 petition), if that employer is not listed in the last 5 years of employment history. Some IO's ask for it and some don't I guess. But if they ask you you can tell them that you filed AC21 at the time of job change versus I changed the job but didn't tell USCIS because it is not required by law etc.

Cons:
1) If you don't file AC21 and your x-employer doesn't withdraw I-140, you might get the approval (assuming all other things are in line) without any RFE. Sometimes filing AC21 could trigger an RFE in case they have more questions on job change, salary etc.

You can decide yourself whether you want to go for AC21 or not. But below is my opinion:

1) If you are changing employers, your new job should be same/similar. AC21 is more peace of mind. New company's lawyer filed AC21 after I changed jobs (not sure if it got tied to my I485 application). Later I got the RFE on employment verification etc. Lawyer replied the RFE and I got my appoval within 5 days after NSC received response to the RFE. The key is to have same/similar job. I don't think salary spike % or even job title does matter as long as I140 job and the new job are same/similar.

Again ... my two cents and not a legal advice. So take it for what it's worth

You seems to be very undemocratic and dictator type personality with an non-secular mindset. Your views are extreme and very disturbing. The person attempted something and every one has flaws in it and so did he. Drafting a letter is not a simple task, its extremely complex and tedious task. Anything gets better and better as we progress, its an incremental process. You have to take baby steps initially before you learn hopping, jumping and leaping.

This guy took initiative, his intentions were correct. As more and more stakeholders come in with lot of intelligence, they are expressing themselves. I am sure this guy is not an adamant and he will incorporate every one's viewpoint.

I don't care about grammatical mistakes in the letter. I don't even care how letter was structured. What I care about is that this letter is full of racy shit and no one wants to put up with it. I have so many great indian friends and I am so ashamed that this guy brought shame to all of them.

I must apologize here for making such a selfish, rigid minded and one sided points to send to President-Elect Obama. I'm also an Indian citizen and I totally agree with you on your irritation and reactions. We are all going to be Americans not Indian American or Russian American. Indians must leave their stuff at home before boarding on a plane to America and try hard to assimilate into this country and become an American. I wish he would’ve drafted a letter representing all potential immigrants to fix the broken immigration system.

I cannot imagine the real America turn into something like this guy’s way!!!!






I agree with you 110%. Get the stupid writer of this letter kicked out of trackitt community and possibly from US as well. Such a racist person in 2008 ...... when few days ago we witnessed the historic moment and saw America changed for Better. We all can't be more proud to be American (and just Ameircan ..not indian American) at this point in history than ever.

here ppl are worried about losing jobs ... worried about getting their GC's and this guy is worried about whether he/she should have family versus individual health insurance. This is ridiculous. Get real and be thankful that you have the choice of family insurance to say the least ...

I think your attorney is to blame. The requirement should have been vice versa. Requirement should be: Masters with 1 year and alternative should have been Bachelors with 5+ years experience. Bachelors + 2-3 is < Masters with 1 year experience.







Yup .. His or her attorney screwed up big time. Who would use 2-y years experience with Bach or 1-year with Masters and still think that Eb2 would fly. I guess the lawyer thought ...

You should get your GC before 2 weeks in my opinion. I don't think you need to file AC21 since your employer is not going to revoke I-140.

My suggestion would be to find another job in 2 weeks:
1) If you find the job ... great (still no need to file AC21 since it is not mandatory by law to file AC21)
2) If you don't find the job in 2 weeks, then continue looking for it


Your GC can be dendied if your employer revokes I40 and you don't have another similar job to use AC21 or if you get an RFE asking for the employment verification and you don't have a job to respond back to the RFE. Based on your case details.. the possibility of this happening is rare ... so I wouldn't worry about it

Was your application filed by those "in"famous law firms? Fragomen etc???



GOGOLE ........ DON'T MAKE HIM/HER PANIC. There will be PERM audits by DOL (for some cases filed by Fragomen) and NOT I-140 audits. But even for PERM audits ,,, no one knows what is going to happen. They might not revoke any PERM certification after going through their audit. Who knows .....

Three ways to know:

1) If you receive RFE
2) Approval mail
3) You call service center and IO is nice enough to tell you (likelihood of this happening < 30%)

I don't know if Infopass would give you that information.

You should be able to get your passport stamped based on I-797 green notice. But IO might not stamp it if she/he can't see you approved in their system.

Chill out ........ I just received approval notice sent e-mail and no welcome notice or card production e-mail. But I received both welcome/approval notice and actual card in mail 3 days later. Btw .. welcome and approval notice is the same form (I797-C)

Topic: RFE for TB skin test

First of all Not a Legal Advice ,,, so act accordingly

I received the RFE for skin test too. USCIS returned the orginal medical form and asked to get the skin test done and send the results back to them (sealed envelope, surgeon signature etc). USCIS IO put corss mark on the TB skin test field in the original form. I asked the civil surgeon to use the new form, just fill in TB skin test section, sign and date it and then eclose this new form along with the original form in a new sealed envelope (signed and stamped by the civil surgeon across the envelope flap). This worked for me because my approval came 4 days after USCIS received my rfe reponse.

Scratching my head and Wondering if you have a degree in legal studies :) ... Let's keep this an immigration forum and not a sue forum. If the "happy sue friend" wants to sue, let him/her sue. Who knows Karma might or might not get him/her for I485.
If I were him/her, I wouldn't have sued the other person under the pre-text of Psychological Damage at least. Btw ... after careful analysis, I have decided to keep up my morality and not sue the civil surgeon. We all do mistakes unintentionally ... have u ever heard: To err is human ....
