Topic: Just ported from EB3 to EB2 with old PD!What shoud I do next?

So I got an email from the attorney saying that my I-140 was approved. Although we asked for a crossfiling but since we have not received the physical copy of the approval I am not sure that my dates have ported. I hope they have.

Attorney says if dates have ported then its a matter of time before I get greened. When I was filing my I-140 we also filed my wife's 485 (couldnt file in July 07 since we werent married), haven't received receipt notice or fingerprinting... I guess I will wait until we receive her fp notice before I start calling up senators, congressmen, infopass. I wish there were a clearer way of having the officer pick up your file and assign a visa # to you.

Suggestions are welcome..

I filed my application yesterday, it was received by USCIS today. It took almost a month for me to move from Labor approval to I-140.
It took almost 8-9 days to get the physical approval. It took paralegals almost two weeks to get this information over to me. After which it was a ping pong of emails (do we have this, do we have that). Finally it was mailed yestreday.... phew...

Despite having fired a warning shot in Jan to my attorney (do you have everything you need from me??? Yes...we do!!!) they didnt move on it until after the physical copy was received... talk about speed

Here is an article talking about a Biometric ID for all Americans (sort of proposed, actually "considered" would be an apt term)... a prelude to CIR they say.. there is more than meets the eye.. I wonder if Americans in general would agree to something like this.... I dont think so... but some information on a backburner issue....

Wow guy, it gives me hope, My case is almost identical to yours. I too have an Eb3 July 2003 PD. I have an approved labor, and we filed I-140 today (more like mailed it today - Premium Processing).

I have been told by the attorney that after I-140 is approved its basically a luck of draw, it could happen very fast or it could take up to 120 days.

This is great news for all those who want to port their PD and not change their jobs..... Please keep us updated of your progress.

And that fee is $ 450....wow... thats double/triple of what you would end up paying if you terminated your ATT contract

I know a lot of this does not apply to us (someday it might) but have a read.

What I found really funny was there will now be a fee to revoke your citizenship....

CNN should profile green cards and the tons of money spent by us to get that document...we stand in line, pay our dues but yet our voices are not heard (and please no color commentary on "you are free to leave")...

First they made it hard for people to visit this country and now they make it hard for people from this country to visit other countries...

Topic: premium or regular (EB2)?

You are EB2 Phillipines so you would be current. Filing premium would mean another $ 1,000 but a quick I-140 decision (less than a month).

However, if you are not in too much of a rush you could go for regular processing (may take upto 4 months). However, I have heard and seen people under regular processing get approved in a month.

Feel like saving some money? I would go for regular... you will save money but may have to wait for 4 months (although all signs point to a speedy decision...less than 2 months).

If you have sleepless nights (might lose job, visa could become U, etc), go for premium

seven to eight months is a good guess (no audits).
Also keep in mind up until April 2009, the speed was 10 months, but now they have picked up pace.. there is a possibility that the time for PERM approval may go down but I am pretty certain it wont go beyond 10 months

Topic: Immigration Reform a Political Gimmick or Is there any "HOPE"

The way I look at it is simple - To get a law passed you need a sponsor and then you need support.

Going by current mood no one will sponsor a bill for LEGAL IMMIGRANTS - where is the benefit....are they a vote bank (NO), are they going to donate (Maybe...mostly NOT) so why sponsor a bill for Legal Immigrants.

For the 12 Million odd not legal immigrants something needs to be done.. again going by current mood in the country no one will sponsor this and very few will support it. Or if someone sponsors it few will support it.

In the best of times it takes a lot of guts and gumption to take this hot potato and make something of it. The party in power is only interested in self preservation (a trait for all politicians) and after this defeat in MA they will be more populist in their approach. Who the hell cares of national debt as long as we are getting a tax break!

I admire BO but he needs to do more than make great speeches, his cohorts (nancy and harry) are hopelessly out of touch with the ordinary citizens and this will translate into big losses in the upcoming election. The Dems know it and Repubs know it as well. There is no courage to tackle this issue. In my opinion Immigration reform will have to wait at least another 2-3 years.

PS: Keep an eye out on the Census findings at the end of this year, as widely expected it will show hispanics as the largest minority and that could trigger a change but this bill is dead...

Guys -

I have heard and read a lot about porting dates from an old I-140 to a new I-140. I have a 2003 PD (India EB3), I was recently approved for a EB2 labor. We are ready to file a new I-140 (EB2) and I need to get thoughts on how do I port my old PD to the new I-140.

I have read about letters, senator inquiries, etc. Surely by now TSC has a process in place to deal with this, but then again this is INS we speak of.

So please give me some thoughts on how do I go about porting dates. Suggestions/Tips are welcome...

PS I have a cover letter prepared by one of the top immigration firms.

This is a very slippery slope.. I believe the rights of this individual are being challenged, I am no legal authority but I am sure this is bordering (if not crossing) some legal line. Holding on to someones passport reminds me of Gulf countries where your "arbab" (and no its not arab) keeps your passport so that you don't run out of the country or change employers. I am not saying that this is forced labor but where does it stop...either you let a person in or you don't... hanging on to someone's passport and letting them in the country sounds daft (what if the guy has an emergency!)...

Finally the dates on icert have moved to April... its really sad... we know they have been processing April and May cases for a while now... I guess this is the official way of saying that we are in APRIL. I wish all the luck to people who are stuck in this line (I saw a few postings from Jan stating that they have not been approved/denied/audited)...
This process is nerve wracking at the best of times...I can only imagine what people, whose dates have passed and have not heard anything, are going through.

So let me ask you a question.

lets say my date becomes current (PD 2003 EB3 India - 485 filed in July 07) would I be able to raise an SR and ask them to process my case.

I know my EB3 date becoming current made you laugh, but seriously, I filed for EB2 and was approved, we file for I-140 next week.

Considering I-140 is approved can I start bugging the USCIS regarding my pending 485 (July 2007)?

Topic: Tourist Visa - No Return Ticket - No Entry

In the guise of security airlines have done many things. If you go by entry/exit procedures in US and Europe it is fairly common not to allow tourists with one way tickets. Although it may be a rule, I dont think its enforced uniformly across the board (see the different responses from fellow trackitters). Furthermore after 9-11 a one way ticket is a red flag.

I am not really clear on your first sentence, did your friend's in-laws come (I assume its not the parents, perhaps siblings) here to the US for the in-law's delivery. In other words did they travel to the US to have their own kid delivered here. If that is the case maybe their own child can sponsor them in 21 years. Still better than EB3 India.

I personally know of at least one family that had come to the US specifically for delviery. So its not unheard of, but perhaps you mean the parents came for the delivery of their daughter (who is already in the US).. I am getting off track here...
