Some help in this regard would be appreciated. I am trying to find out how long is it taking for a PERM to get approved. I recently completed the placing of ads (PERM to be filed in March!) and the attorneys mentioned that PERM is taking anywhere from 6-12 months (without audit) 18 months with audit. Lucky me I have a firm that has been in the news of late for having its cases audited a lot...
I had EB3 India (2003). Planning to file EB2... My H1B expires 2010....this is the most broken down process in the history of mankind. I am not even sure if this can be called a process... Oh GOD please give us some relief.... |

I am looking for some advice... My mom travels to US every year and usually stays for 4-5 months. This year she stayed for almost 6 months. She is planning on coming back December 08 (less than 5 months since she last left). My fear is that immigration officers might not give her the 6 month stay. Anyone faced with similar situations in the past...

Sorry guys... Anyway the requirements are based on your job. In my case I was able to file EB2 with the same employer. We will see if it gets approved by DOL.... Still very early days.... The only thing my attorneys told me was that my new role (EB2) is at least 50% different than my old (EB3). There is plenty of stuff out here which talks about porting of PD.
The biggest obstacle was to convince myself that EB2 was the way to go. I had a shot at filing for EB1 as well, I was going to take up an international rotation...however, the global economy tanked and things were not as green as I thought they were...besides I foolishly thought that EB3 would progress... |

Live: I certainly feel your pain, I too struggled with this decision for a while (my PD is July 03). Technically its just a few months from you but in reality its like light years away. I agree with one of the posts that say that in the past 3 years the PDs for India have been in Nov 01 (although it has moved in between).
Bottom line is its a personal decision. You have to factor things like, do you have EADs/AP, are you comfortable with changing jobs (assuming your current employer does not sponsor for EB2), additional expenses, PD trend going forward (i think its pretty bleak).
Read some other posts and you will see that there is a consensus among people that if you are PD 2003 (INDIA) you are better served filing under EB2. My personal opinion is you don't file under EB2. It will end up taking the same amount of time (2 years at least). |

Did anyone notice that for the December bulletin they have not included any language forecasting for the future... November bulletin had the following:
"D. EMPLOYMENT VISA AVAILABILITY
The level of demand being received from Citizenship and Immigration Services (CIS) Offices indicates that they have a significant amount of cases with priority dates that are earlier than the established cut-offs. This is likely to result in slow forward movement of the cut-off dates for most Employment categories during the next few months. Sudden changes in the CIS demand patterns could result in fluctuations in the monthly cut-off dates, and retrogressions cannot be ruled during FY-2009."
No forecasts for December..... Not that it matters but I found it strange...... |
Topic: A very very very very small step
I am EB3 India (PD July 03). I have finally convinced my employer to switch to EB2. After the employer approved, we spent almost 3 weeks to a month preparing the job description and getting everyone to consent (HR, Immigration, Attorneys etc). The recruitment will start soon and will take another 4 months after which we will file for PERM (who knows how long that takes). I am assuming if everything goes well my PERM will be approved somewhere around middle of next year.
After which we will file for I-140 under EB2...another year or more for that...unless there is a rule change and they start premium processing... (I know the chances are like lightning hitting you thrice in a day). And after almost 2 years (2010) I believe I will be current for I-485 approval. Which could take another year or so (processing times, receipt date, notice date, rfe.. you know the drill).
Its a 3 year plan and I hope to keep my fellow trackitters updated of my progress. I figure EB3 is... dont have words for it and wanted to switch into EB2, basically I am comparing 2-3 years (EB2) vs. Unknown (EB3). Life goes on...
I will update my case specifics and will keep fellow readers (esp the ones who are contemplating such a switch) updated on my development... Lot of discussion of late on switching categories....this can help people benchmark... |

dpreddy can you tell me when did you apply for your I-140. I want to know how long it took them to approve your I-140 - Thanks and good luck. I agree with the answers in this forum. For 2007 it may be a long wait but stranger things have happened... you never know... |
