I have been through the same situation a year ago, my company went for ch11 way back and after that they filed my I-140. But my I-140 was approved and H1B1 was also renewed after ch11. But I am sure it would be best if your paycheck should be running on-time with your employer A2P and with little hike in salary. The USCIS may ask you or your employer for your past W2s or recent paychecks for renewing your H1B1s or while approving I-140. By the way I also got EAD extention successfully ofcourse my employer is out of ch11 now.
If your employer is out of business, you should change your employer and transfer H1B1 using AC21. Thats always a best option I guess. |
