Everybody wants my writ of mandamus.!!..
Well...If you file WOM....by yourself. (Pro Se).....then you are required to have a subscription to PACER website: http://pacer.psc.uscourts.gov/
as part of the process, There you can search and find anybody's case (complete with printable/viewable documents documents) who has ever smoked the USCIS. It is so interesting to see a barrage of cases that were all settled within 3-4 months by the plaintiff "MYSTERIOUSLY" :)

For simple .doc format templates, please refer to the immigration portal link above on this thread...

If you file thru a lawyer, you don't need to sweat on anything....they are minting money right an left....

Interestingly, PACER is also a good site to pick up the lawyer with the BEST BITING TEETH :).... Search your district, with civil case type of 890 and put Mukasey (Honorable Mr. Mukasey from USCIS) in the party name...It will spit out all the cases done so far. Pick up the cases with shortest settlement time...Bingo...That is your Lawyer....

He actually completed the whole form again, but filled all old info (with old dates)... EXCEPT the TB test section that had the new info and new date. He checked "No follow up needed" in that section. CXR results were also added as negative. He kept all the test result and CXR result papers that i gave him for his own files.
(He had skipped doing the skin test last time with just a normal CXR.)

Also He noted in the comments" Patient is not a Public Health risk"

You guys are MOUNTAINS of courage ... Hats off to you all !!
I would recommend smoking them with a Writ of Mandamus...if your case is Rock Solid..
These four-eight years could have easily counted towards your citizenship time...

Your I-140 is the basis for your EB-2 or LC based petition. It is very strange that it is not approved. Unfortunately your I-485 CANNOT move (and will not be sent to an IO) if the I-140 is not cleared.
You should request release of documents to you under Freedom of information act (FOIPA) regarding your I-140.
Something is wrong with it if it has not moved in that timeperiod.

The best shot would be to do NEW one...but they may not be an option for you.
Make sure your lawyer is not lazy dude..

Civil Surgeon fills your I-693.
My surgeon is 3 hours drive away.
He asked me to get the TB skin test done at my local lab, get it read (3 days later) at the sam place and get a chest X-ray done too (we knew it would be positive), and THEN come to him. He filled a new I-693, and specified no public health risk on comments. No follow up requested.

It was furlough RFE...But you have no choice. If wrong items are ticked off, or your civil surgeons did not do a TB test...they would not proceed further...

I filed my own and spouse I-485, LC, I-140, all by myself.

I filed WOM as a pro se (self) as well. Courts have a very soft corner for Pro Se.. The process is surprisingly simple.

I did not play golf anymore :)...My hobby till now was preparing for and submitting the above....I actually enjoyed it :)

1. Did you use priority date recapture via another higher preference category (EB3->EB2 or EB2->EB1 etc)?

2. Did you use LC substitution, if applicable?

3. Did you push via the senator or other authorities? Did it help.
I tried but did not help. The offices appeared to have boilerplate answers. WOM helped. I filed as a Pro Se.

4. Did you take an infopass appointment ? If you did, how was it helpful?
3 times: very frustrating. I drove three hours to get toa five minute face time, with NO information and a lot of ATTITUDE..

5. What frequency did you call the USCIS (if ever)? And was it helpful?
Every week...used as a stressbuster :)..Any practical help...NO

6. Who was your attorney?
Pro Se (Self-petitioner) ;)

7. What do you or your attorney have to say about the delays (if any) in your case?
Always Agrees 100% :)

8. Whats the count of dependents in your application?
1 spouse

9. Did you have any interview? How did it go? If so, how many weeks/months before the approval did it happen?
NO

10. Did you face any RFE/NOIDs? If so, what was requested and how many weeks/months before the approval did it happen?
RFE 4/08...replied 4/22/08....rc'd 4/28...approved 5/5/08 (last day for USCIS to file repsonse to my WOM ! :)

11. Did you do a service request? If so what all times during your process you requested it? Also, what help did it provide, if any?

Got the GREEN/PINK/WHATEVER Email...

My case did not move for 13 months....TILL.....I smoked them with a Writ of Mandamus....
Very interesting facts:

1- May 05 2008 was the last day for USCIS Attorney to file a response to my Writ in the District Court. "For some STRANGE reason" :), the case is adjudicated and card production ordered on the same date.

2- RFE ordered for two very frivulous things: TB skin test and BC. Both were submited before...

This case, like hundreds of otrher cases against USCIS will go as "SETTLED" before ANY hearing...and nobody will be able to pull up cases decided AGAINST USCIS... They make SURE there are none !!

My advice to anybody whose case is frozen for no apparent reason and is beyond the projected tiemline...is to smoke the USCIS with a Pro Se Writ of Mandamus...

Yours sounds like lucky exception. Now a days...No TB test..No immigration...It gives an easy breather to the adjudicator to buy some time to sit on your application...... I am sure your case must have been more than 6 months old...

If follow up is checked...IO can buy even more time.....any reason that they can use to justify their delays...

SUNYD,

Go to a CIVIL Surgeon and hand him the closed envelop sent to you. It has your old medical form submitted initially. You don't have to go back to the same civil surgeon. They fill out a new form. Tell them to add the old form too to the sealed envelop that they will give you.

MAKE SURE THAT HE "DOES NOT" check the box " FOLLOW UP NEEDED".....If he does, you can be TOASTED by USCIS...Find a new civil surgeon..and to be on the safe side get an appointment with your doctor to discuss the results (for you own health).

Ask you doctor to specify in the comments section that "Patient is not a a public health risk".. This is what USCIS cares.

Send the SEALED envelop back with express mail ASAP.

My Friend is a Lung Specialist...He also had to get the TB test repeated :)

Affidavits should be no problem. But I will wait 45 days.
I think the only reason my case moved after a year was my WOM riding USCIS behind (submitted 3/12/08), with mandatory court answer date approaching (May 12th!)

Topic: Birth Certificate RFE's.... ? Secondary Evidence ....Post your experience

The boilerplate description attached to Birth certificate RFE mentions about secondary evidence (Affidavits from those who witnessed the Birth etc.), if the birth was not registered at the time of Birth.
I am sure there are many people whose birth certificate was issued later than the time of birth....Is USCIS very STICKY about this secondary evidence?.....DID ALL of delayed registeration get a NEW RFE requesting the secondary evidence
