Did you get new I-94? What is the validity of that I-94?
You can get the date corrected and get new I797 from USCIS.

You can not work after your extension denied. So there is no question of serving notice period in US.
You can still resign and leave employer A without service notice period and ask employer B to file for H1.
Anyhow you have to leave the country.

By not leaving the country you are taking a chance of being illegal.
Even if you stay here and your H1 with employer B approves, there is less than 1% chance that they will give you new I-94.
So in any case you have to leave the country and come back.

So better to not take a chance of being illegal.

I have a question for you though. After your first laid of you join the another job after more than 60 days, correct?
Did you get H1B approval with I-94 or you had to go out of country and come back with new I-94. Also can you give me the timeline, like what date did you applied for new H1, what was the last pay stub you supplied and what else document you send.
I am in a similar boat. Your response will be helpful.

I have applied for H1 and H4 together in august. Now I upgraded my H1 to premium.
Will they approve both H1 and H4 in premium or just H1 will be upgraded to premium and H4 continues in normal processing?

What about in non concurrent filing? I have filed for H1 transferred about 1 year before current H1 expiration. So I could not file EAD that time. So once my h1 transfer and h4 gets approve, how soon I can file for H4 EAD renewal?

For how long you will be in this fear?

Also if you pay less than 1000 in rents for 2 bedroom apartment, I think its still wise not to buy house.
If you pay 1500+ then its definitely good to buy at least 2 bedroom townhome. EMI plus tax will be little more than your rent.
You will build up your equity over a period.

Personally I think, if you can not enjoy the money you are earning than there is no point to stay here and better to go back.
Once kids are in college, you will hardly get chance to stay with them in your own house. Once the time gone, you can not do this things. So better to buy and enjoy with family.

Topic: Immigration reform bill next year

Any reform which is not comprehensive (ie. include path to citizenship for undocumented) will not get support of Dems.
Any reform which include path to citizenship for undocumented will not get support of Reps at least under current president.
We will continue to see executive actions based on the political situation.
Forget any major reform for Employment based category which give GCs in wholesale.

Dems might be ready to support to scrap the Diversity Lottery if they get good deal for DACA people. Again that is also only if current admin is really serious to get rid of DV lottery. The manner in which current admin is working in any of the issues like Obama care repeal, or tax cut or immigration, I dont think they have made any serious attempt.

1. Can he/she reapply to new H1B petition immediately if first one is denied with same employer? - Yes. But getting new petition approved in current circumstances is difficult. Even if new petition is approved there is a very good chance that he has to go out of the country, get a new visa (if one is not valid) and come back.
2. Again lot of things are depend on the current validity of I-94. If the I-94 is still valid, it wont be a big issue staying in USA for 1-2 months. If I-94 is expired and staying in the US, it will make them illegal and it can have very bad consequences in subsequent H1 filling and obtaining Visa.

Just go out of country and come back. This way you will get new I-94 valid up to the petition validation date.
If you go to Canada by road and will return withing 30 days, at POE explicitly tell the officer to change the I-94 date.
