I am in the same boat. Sent RFE response on Sep 11...waiting since then.

Also PD is retro...so we have to wait for the dates to get current.

Topic: Serious Problem Pls Help

1) Don't worry.
2) Employers can run payroll without paying any taxes on your side. These taxes will become due when you file taxes around April. This is has nothing to do if he paid FICA or not. I am 100% sure.
3) Meanwhile inform your employer abt this and ask him to deduct FICA. Also fillup W4 [google it] and send to him.

Topic: Effect on pending GC

YahooGC: Thats wrong opinion. INS keeps I-134 affidavit of support and attach to your SSN. Don't do anything stupid thinking that no one will know. They will haunt us BACK :))

For example : I changed my lawyer after filing I-485 (before replying to an RFE), new lawyer asked me to sign a doc where it says he can request I-134, AR-11, I-140, 485, 797 forms. I asked him abt I-134 affidavit of support that above statement was explained to me.

As far as I know (I did extend my mothers Visa last year), Once you apply for extension its safe to stay. But if you get a rejection (after I-94 expires) you must ask your parents to leave with in a week.

But 99% of the cases will be approved for extension. Just put a letter saying they need more time in visiting east coast and these are the places. & Since we work fulltime we only get week ends and long weekends for these vacation etc....

RD & PD have there own priorities.

Example:
Case1: PD: 2000 RD: Aug 2007
Case2: PD: 2006 RD: Jul 2007

Lets say USCIS processes all the RD for Jul 2007. There is a very good chance that PD 2000 [case1] may not get the approval where as PD 2006 may get the approval. …This sounds bull$hit [oh! Yes I am with you]. I have seen cases like this.

On contrary: they started processing case 2....let say they issued RFE. RFE was sent and everything is OK. In the mean time processing dates moves forward but PD retro gates.

Case1 will be reviewed and put in a shelf requesting visa number when PD is current [wrt that case….that's the reason we see lot of soft luds….USCIS actively looks at this self just in case any case is current]

When case1 is reviewed [some times these cases are reviewed irrespective of RD] if everything is OK they will get GC.

Also I am victim of visa bulletin ret rogation. RFE was sent 6 weeks ago …I see at least 15 soft luds after that….PD is not current.

Some one also said to me that by law USCIS can't give GC unless PD is current.

BTW what are the documents required for Info pass??

GCVictim99 sorry to hear your story:

1) Why did he revoke your I-140. Did you leave him ?
2) Do you have all / any the paper work for your GC ?
3) Best scenario : Apply AC21 [mention something like, you already left the old company at so and so date and sending the AC21 now etc….they might ask financials from the new company for I-140 ….
4) Worst case : Join the new company, apply PERM, Apply I-140 and request Portability to use old PD [this is possible].
5) Do you mind sharing the company name? Just in case?

It could be USCIS mistake. Since PD not current I think its because of I-140.

Like:
is your I-140 approved?
Is the company has good number of employees?
Is is generating good money?
Were you on bench for any period of time?

I am 99% sure that this must be related to your I-140. Even after the approvals...USCIS rejecting the applications when ability to pay comes into picture...

Hold your breath...and good luck. This is tough time to pass thru...
