I used to haved h1b visa before which starts on feb 2004 and ends feb of 2007. Since I went to US by july of 2004, can I recapture the lost date on a different employer?I'm not on the US right now and also I have a pending Perm applications on my new employer. Thanks!!!

Folks, I used to work in United States on H1B. And when I had just one month left on my H1B and PERM application was still not approved, My lawyers asked me to go out of united states to conserve one month of H1B time so that I can use it later on for re-entering US. Now my PERM application is approved and they are about to file my I-140 application. Given this situation, I want to know a couple of things:

1. Can I apply I-140 in an expediated form and is there an advantage in filling that way?

2. Once my I-140 is approved, Can I get a H1B VISA extension for three years using "Consular Notification" process?

Please respond quickly as I have to make some quick decisions....

You had your first LUD on the working day Monday July 14????? I would say your I-140 is approved!!!!! then you had another LUD on July 27, probably waiting for 485 process...

I HEARD FROM A FRIEND OF MINE WHO HAS HER BEST FRIEND WORKING IN USCIS THAT THERE ARE SEVERAL DEPARTMENTS THAT CHECK FOR GC PROCESSING..EACH ONE APPROVE AND PASS TO ANOTHER DEPARTMENT...IT IS NOT ONLY 1 IO... LET'S SAY GUYS :WE ARE IN THE TUNNEL OF 485!!!!!

I appreciate your spirit and positive attitude. I guess you misread my post. 14-July-2007 was the first LUD. That was one year back. The second LUD was on 07/27/2008, after completing one year in the same status.

Some time back I moved from TX to MI. Any way, I went ahead and changed my address online thru AR-11 yesterday night. Let me keep the forum the developments if any.

I have gone thru your posts and have a quick qn. My labor sub PD is 02/15/2007 and I-140 is pending at NSC since 06/29/2007. I received LUD on 07/27/2008 and the earlier LUD was 07/14/2007. My I-485 is pending at TSC since 08/02/2007.

Are you saying that people like me will get greened now? Thanks in advance for your reply

Not worth seeing it for EB-3 I-140 cases filed at No Service Center Nebraska. 22-March-2007 is the cut off day for EB-3 I-140 cases filed at Nebraska.
