Topic: Multiple I-797; I-94 validity

My current I-797 is expiring 4/23/2017. My employer duly filed my extension in December 2016 and I got a new I-797 valid from 4/24/2017 - 4/23/2020. This new I-797 has a I-94 attached to it which expires on 4/23/2020. I forgot to submit that while leaving the country.
I visited my home country in January and got a new visa stamped till 4/24/2020. Upon my arrival i presented the office at the POE with the new I-797 which is valid the 4/23/2020, he stamped my passport with admit until date of May 2020.
Seconds later he asked me show my current I-797 which is valid the 2/23/2017, he then cancelled the 2020 stamp and updated that to 2017. He also told that I need to check with my lawyers on how to get the i-94 updated without leaving the country or I can travel out the country and comeback to get my I-94 updated (Given the current state of affairs I want to avoid this if at all possible ).
My company's immigration team tells me that the officer made a mistake and I can rely on the the I-94 attached with that extension which will kick in automatically in 4/24.

Now my question is that does I-94 automatically kick in or should I visit the CBP office to get it corrected ? Also what should be mindful of so that I do not accrue illegal time ?

Topic: Proposed Rule for I140 EAD - RIN 1615-AC05

Thanks for the reply. I still don't understand.
1. The spouses are not the beneficiaries of I-140
2. Since the primary criteria for this rule and for H4 ead is an approved i-140 how does this benefit those who are not eligible for EAD under the H4-EAD rule.

Can you be kind enough to explain this just once more.

Immigration noob here. Can someone please explain if this rule goes through how will the H4 dependents benefit from this or rather how will this make the H4 EAD rule inconsequential ?

Topic: EAD for H4 Visa Holders

This is probably a dumb question, but is anyone following the lawsuit hearing that was to happen today ?

Topic: EAD for H4 Visa Holders

I have a question the eligibility, can someone please explain what the following mean

Principal is beneficiary of PERM that was filed 365 days before end of 6 years
Will this make H4's of people who are waiting for audit response beyond one year eligible for EAD ?
Also what happens if the H1 holder is waiting for an audit response and enters the last year of H1B ?

Congrats to all on getting this far, one last push and we will be there !!

Topic: EAD for H4 Visa Holders

I have been following this thread for a while now. I am so happy for all those that will be benefited by this rule.
My question is that is it a part of Obama's EO, meaning that it can be revoked by a future president ? Or is this rule for here to stay since this is handled by USCIS ?
