Topic: EC times in Australia FOR THOSE WITH AN HSMP APPROVAL LETTER

hello all,

Two of my friend received their entry clearance this week, one of which was on a WHM visa who initially had his entry clearance refused because of the 50% rule. He came home early merely to switch over to a Tier 1 visa and like maby others, has spent months waiting in anticipation. After they reviewed his situation, he was granted clearance this week.

The other friend applied at the end of September and her clearance was granted. She too was on a WHM visa, but wasn't refused clearance at all as she applied after the whole WHM visa debacle had finished.

Hope this gives some people hope. Sure makes me feel better about my application that I'm doing in December!

With the current economic climate... probably not.

But... it might be worth getting an immigration agent to look at it. 1st Contact do work on the whole "no visa, no payment" thing, which is who I am going through for EC. I did HSMP by myself which seemed pretty straight forward. They are a necessary evil, but I basically need them to say what documentation I need to provide. You could shoot them an email explaining your situation and see what they say - they won't charge you until forms start being filled out. I've been talking to my immigration agent for the last month and haven't handed over any payment details!

Yes... it's not promising.

The work permit option is hard as she would require sponsorship from a company.

The marriage thing is the easier option... although a bit extreme for visa reasons :-).

Does she qualify for Tier 1?

I can actually answer this - I'm trying to get my partner as a de-facto partner on mine.

Basically, when you go for EC, you'll need to fill out form VAF9 which asks if you have a partner who is or will be joining you over there. You then have to provide their details, etc, which is fine. As part of the supporting documentation, you will need to provide documental evidence proving that you have been in a relationship at the same address 2 years prior to applying for clearance. So basically, anything joint is very helpful, or any insurance where your partner is a major beneficiary is always a good idea.

I've been somewhat sentimental and kept everything... and then when I learned about this a few years back, I kept almost everything that was sent to us in at the same address.

I'm working with an immigration consultant as same sex relationships are bloody hard to prove. Especially in Australia where they're not officially recognised.

Hello all,

I only found out about my application because venkat mentioned that they had reached a decision on a June 4th application (his). I called them and just about the status of my application. It turned out that yes, they had reached a decision but my email address had been recorded incorrectly and their emails to inform me that my application was ready had been bouncing back. The girl on the phone was lovely and she put me on hold to speak to my case worker and asked him to re-send the email. I got the email almost immediately from my case worker.The girl on the phone told me that she couldn't tell me what decision they has to come to until my documents had left their offices. She was very sweet and could understand my nervousness.

So I got off the phone, sent a request to MBE Sheffield to have my douments picked up. I replied to the email from my case worker and told him to expect a courier to pick the documents up. I then thought that it might be worth a shot to ask what the decision as the worst he could say is no, you'll have to wait. I didn't expect him to tell me that it had been approved.


I didn't expect to have a decision this week, as like Em, my application was received in June and they are clearly not in the June applications as such. I was lucky to have a really cooperative person on the phone and a fast case worker, and I was quite prepared to tell me mine hadn't been assigned to a case worker. I understand Em's blood boiling anger and frustrtation, and yelling at them doesn't affect your place in the line. However it does leave you feeling quite bad afterwards. And Kiko, the people who answer the calls and the people working on the cases are two different groups of people so calling them like as you say "Mad Dogs" really doesn't affect the speed of your application. The call centre are there to answer your calls. What I do agree with though is that getting angry at the person makes it harder to get any useful information from them.

I do feel awful for people in Em's situation who have lost a lot when they've done the right thing. The whole process has been long and drawn out and really quite frustrating. And our handling of EC in Australia has made things worse. I can only say, hang in there because it's so close. Good luck and get some positive thoughts going - you're almost there.

Yes, that is exactly it. Does that mean that with the Home Office being so unreliable in sending emails to say that the documents are ready to be picked up, that I'll have to call closer to my processing date to find out all the other details for the MBE Sheffield.

This is one of the most convoluted things I've ever done!
