Topic: Case with Supervisor!!!

I called USCIS yesterday. After the usual initial talk with rep, the rep transferred me to next level Officer(mainly because I have a pending SR). Though I felt the office lacks enough knowledge, she repeatedly assured me not worry as my case was recently assigned to a supervisor for review. I am assuming that the review means adjudicating process. I do not mean to be pessimistic but do you think the officer is fooling around or case assigned to supervisor mean anything?

Please note that it is not uncommon that your 485 is approved but your 140 approval is not updated yet. However, please understand that your 140 is approved. Its just that your 140 status is not updated yet.

Topic: Has any one done analysis on loss due to status checking by GC applicants

I dont meant to say that you are naive but loss does not necessarily be in terms of time loss. I think you need to get bigger picture...

Lets face the following facts:

1. Not many GC applicants cannot question much when his/her salary is not appraised.
2. Not many GC applicants can accept promotions.
3. Not many GC applicants can consider job change(in some cases, location change).

Keeping in mind above facts, lets say if a applicant started his/her GC process about 5 years back with 60K, now his/her market value can be anywhere between 100-120K. However, it is not surprise that many applicants are drawing less than 90K. If this applicant gets his/her GC approved today, do you really think 1. He/She can demand 120K? considering that this person is asking more than 30% hike? 2. He/She can really get a position he/she desires though he/shedeserves? I think the answer will be a big NO except for few exceptions. By the way, I have not even talked about mental agony.

I would send out letters/emails every month to all the parties concerned. I would make sure that I do send it to the Highest possible officials. Other than that, we can just wait. Maybe Pray and try to keep a sunny disposition.



Are you still represented by Attorney? If so, what does your Attorney has to say about your case delay?

You can enter back with valid(unexpired) H1B/AP. However, you need to let IO at PoE know that you learnt of your AOS approval while you were outside.

You should be fortunate not to be from India/China. Besides, EB GC is becoming more and more of an issue of fate and luck. Finally, it is wrong to tell people not be anxious after seeing unfair practices of USCIS. There is nothing wrong to be patient just like there is nothing wrong to question an unfair practice. I hope you agree with me.

Ofcourse, sometimes people tend to over react a bit but thats ok I guess.
