Topic: Can this happen

I wouldnt be suprised to see EB3I dates to move rapidly to generate demand. 2011 looks ambitious. I would put my bet on 2009. If CO decides to be nice (also to prevent reverse porting), he might end up moving both EB2I and EB3I to a 2011 date. I doubt many of us will risk porting if we had a pending 485 in a certain category (pretty much why many EB3's upto Jul 2007 did not port to EB2).

You mean 2011 June-dec EB3's or EB2's? I can only secretly wish that what you predict becomes true. We really need to see some movement. This group has been through too much already.

What is your opinion on the visa diversion, possibility to EB1, this year? I somehow feel EB3 should be expecting a big SO from ROW but since EB1 is no where close to having a cut off date and EB3I hasn't seen any aggressive movement so far, visa wastage/diversion seems imminent. The only possibility of that happening is to move the EB3I dates aggressively to generate demand early in the FY and use them up in the second half depending on the SO. It doesn't look like USCIS/DOS thinks the same way.

Extremely optimistic. By the end of this year, a lot of the 2008 EB3 folks might be able to file i485. If CO decides to move aggressively, he might move the FAD to Jul 2009 (to generate demand data). I dont think EB3 is as sparse as you think. 2009 EB2 however will stagnate for atleast 3-4 yrs if every year was like FY17(no SO). However, I do expect EB2 to get some SO this year due to the slow PERM approval rates but EB1I had already consumed 7000 visas this year and CO doesnt intend putting a date on that category in the next 2 months. Unless that category has a cut off date, SO redirection from EB2/EB3 to EB1 is inevitable.

From the pending inventory, it looks like they have about 8-10K i485 applications filed so far but as you might already know, they keep fabricating the pending inventory all the time. The PERM data in the above link includes both EB2 and EB3 together. With porting constantly happening, the inventory has been something even CO has not been able to assess. He moved the 2008 dates assuming a certain inventory and later was surprised by the new filers(mostly porters). The surplus EB2I got in FY15 was due to CO's wrong assessment of 2008 numbers.

What spill overs are you talking about? The only SO's that EB3I has been receiving so far is from EB3ROW's quota. These numbers will always go to the most backlogged category horizontally which would still be EB3I. EB2 will benefit from either EB2ROW's surplus or EB1 surplus. Neither of them seem to go down anytime soon. The only hope for EB2I to get any spillover is the next recession.

There has been a lot of bias towards EB3 from CO/USCIS/DOS part. Year after year, the SO has been diverted to EB1 or EB2. I would expect EB3I to get to Jan 2008 by October ONLY if they honored the FAD the next month. Filers from Jul 2007 onwards will have an additional interview and they would need 6 months to schedule it, if they intended to not waste visas. If they were allocating the visas as per SO rules and didnt waste any visas, I would expect EB3I to get to Jan-2008 by Oct 2018, Apr/May-2009 by Oct 2019 and sometime in 2020, we might actually see EB3 get past EB2 (I would expect the dates to be early 2010). If there is a recession before that, EB2 will keep up due to the vertical SO but there are so many if's and but's.For now, we can only hope there are no visa wastages/redirections happening for EB3I.

Where do you expect the 1-2K to come from? EB2ROW had a good demand and EB1 didnt leave anything to warrant a SO. EB2I was enjoying SO from FB but even that has dried up now.

Actually EB3 is under allocated again by 2230 visas. EB1 has been over allocated again. This injustice keeps happening year after year. Shouldn't we be voicing this out somewhere? This is totally unacceptable.

HR392 is not a rule yet and therefore nothing to be saved there. It is a long shot and though I would like to see it happen, I doubt it stands a chance with this admin...

Thanks for replying. I did exactly that. Now the waiting game continues like before. After 5 long months all they could do was a typo error and God knows how much more longer they want to keep me waiting. My drivers license has expired and until they fix this issue I might not be able to renew it.

Hi

My H4 extension was filed with Vermont Service Center in Feb,2017. Today I received my approval notice, but the Class of Visa is mentioned as B2 instead of H4. Has anyone had this happen before? How do I get the class corrected on the approval notice?

This happened with me in the past when I went from L2 EAD to H1B. But in my case I wanted to continue on H1B since it started after my L2 expired and wanted to revoke the L2 extension. My attorney advised me to do nothing and said the L2 extension would not go through by itself. The explanation my attorney gave was, once the COS is approved, it implies that the candidate is no longer in the old status and it therefore cannot be extended. Very unfortunate that your H1B got approved before the H4 extn.

Was your H1B's extension and H4 extension approved before you filed your EAD? My H4 was filed concurrently with the H1B on with a receipt date of 02/15 and while the H1 was approved on 04/14, the H4 is still pending along with the EAD. Was wondering if I can raise an SR now or should wait for 90 days post H1B approval.

H1 RFE was something about my spouses job(regular one I believe)and EAD as I mentioned was asking for H1 approval( actuallythe ead rfe was generated when the h1 rfe response was juz sent back- looks like they didn't see that when they sent the ead rfe. So I replied back with the approval copy explaining the situation).

Mine was filed on Feb 15 and am still awaiting approval. H1 was approved in premium 3 weeks back after replying to RFE. The EAD had an rfe asking for h1 approval copy and response was sent last week.

H1 and h4 received : Feb 15
H1 approved: April 14
EAD received: March 2
EAD rfe: April 17
EAD rfe response received: May 1

H4 and EAD expire on june 15. Hoping to see approval of both before they expire.

I'm the same situation. H1 was approved under premium on 4/17. H4 shows case received and ead is under rfe asking for h1 rfe response(h1 rfe response was sent and h1 got approved by the time the ead rfe arrived). Got the h1 receipt copy today and going to reply to the rfe tomorrow.
