I don't think there is any issue in enquiring about the status. They know it takes time, but nothing wrong in lobbying for it in their own way. Lets us not discourage anybody.

Great news. Amazing efforts by this group and especially the members who attended OIRA meeting last month. Their actions definitely helped everybody including members who were discouraged of the fact that the earlier proposal included A2C1 6yrs limitation.

Now that we know it is applicable to everybody with approved I-140 or PERM+6yrs we should work as a one community to push this the end line.

Great work....really appreciate your time and effort into this!

From their question about transferring to H1B, it appears like they don't know how difficult it is for H4's to transfer to H1B. Hopefully, this meeting gave them a new perspective and much needed information to review and move forward with this rule soon.

Just a minor feedback.

1) Should not presume that all H4 visa holders are always women. "when they join their husband" should be modified to "when they join their spouse. Most of these H4 visa holders are women".

2) Second point should emphasize on, because of green card backlog for some specific countries, the last step in the process I-485 takes most of the time. Hence wait for a spouse on H4 visa to get EAD is more that 10 years in these cases.

I guess if they pass RIN: 1615-AB92, there is at least hope for others. However, if they propose more inclusive rule to include all H4's, it will be the best.

Per ICERT they are processing March cases. Hopefully you have a result soon.

My case already crossed 11 months without audit. I am trying to find out options available to me. I will let you know if I find any.

Yes. This delay is really bad. Its frustrating to have no response. I have been waiting 11 months already. Given that they are approving Mar cases according to dolstats.com.... I would say there is a chance your case is not stuck like mine.

BTW, there is no hard and fast rule that you have to wait 3 months. You can inquiry if your attorney is willing to. But inquiry doesn't help much as I already inquired twice. They just reply back with current status "in process".

Thx. I have looked at this post earlier as I was in touch with user/Neev in Dec PERM thread. Unlike his/her case my case is not listed in any disclosed information or BALCA. I don't know much about FOIA, I will explore that. Please let me know if you know any details.

My perm was filed in Dec 2012. I didn't get any response from DOL yet. NO audit yet. It is close to 11 months already. I work for MNC-fulltime.

My attorney inquired DOL twice, they always get the same response that it is "in process".

I am in 6th year of H1B already. Just wondering if anybody else is in similar situation with unreasonable PERM delays > 10 months without audit and if there are options to explore to process my case.

This is not the case always. There are few cases which are just stuck in waiting state without any response like mine. Doesn't mean its an audit or denial.

I got DOL response that they are yet to process my case. ITs been a long waiting game...

I am not sure if I understand your ask correctly. As long as you have started the GC process you can get extensions beyond 6yrs of H1B limit. If your PERM is pending for 365 days or if it is approved you get 1 year extension. If your I-140 is approved you get 3 year extensions.

If you did not start your GC process and completed H1B 6 years, you might have to go back to your home country and reapply for new H1B. Of course there are many options here depending the case.
