I missed my 2012 boat for the EAD, I don't think I would have been as bitter as I am now if that atleast EAD had worked out.

Everybody has their take @wildcat and all others, everyone's journey is different and we all choose things based on the information at hand.

I am happy for you believe me , one thing though the optimism that shines through your post I bet wouldn't be there , if you hadn't gotten your EAD.

"Just be happy as long as you have work to do and feed your family.", for various reasons that phrase has lost all it's meaning. I swear I felt that way around 2012 - 14, and from then on it's been a downhill journey and as of now I am trying to look at more philosophically, and considering plethora of options including "leaving and coming back in 2 years when it's current" to "well damn it's Trump now, who knows what's going to happen of travelling back and forth"....etc to status of I-140 etc.

Anyway, I hope for all of us who have been here longest, I wish you success/happiness and new year that truly brings changes to all our lives, and maybe just maybe we get greened , because we sure ain't going to Australia or Canada now lol....

I am sorry I had to share my pain here, completed 17 years and 2 months, still haven't filed for even EAD.

First time around filed in EB3, and by the time I filed for EB-2 never got to the PD date never came end of 2009. It's really sad, sometimes feel like God has forsaken me/us, never knew all of this like 8 years ago, I would have move heaven and earth to file for EB-2. Grey hair is building up, and seeing folks and relatives in Australia etc, have even gotten their mom/dads their citizenship already, and we are still like beggars waiting for our "coveted green cards". Most of our misery comes from here with EB-1 filing, check this data out :

I am tired of saying and wife is tired of hearing it, and the misery continues without having the option of moving to the job you chose or make life decisions. It's pathetic, every year comes and goes.....God stop playing this cruel joke on us........well that's all I have to say now.

I wanted to confirm your original understanding, that this is ONLY for folks who have already applied for I-485 and what kind of jobs that can move on to. Yes my friend, if you thought the employment based immigration couldn't get any crazier, so let's say you filed for I-485 and it's been pending for 180 days and you thought now I can finally work anywhere, well guess again if God forbid if the job was slightly different than the one you did when the I-485 was filed there's a good possibility they won't let you change status (to a green card). That's how crazy it's been with these laws, so go figure the minions at USCIS finally did the right thing. But, this has nothing to do with I-140/EAD, and looks likely that thing is dead for now.

Can you elaborate a bit better, you have two PERMs now is that correct ? Both have been picked up for Audit, and one is now in Supervisory Recruitment ? It would be great if you can clearly specify Case Date, Audit Date, and Supervisory Recruitment date ? Mine as far as the last information I received is "still in Audit" category although seems like I am heading to the same Supervisory Recruitment category.

I tried to check yours man, and didn't find the number in both permchecker.com or the icert website, but if your lawyer said if it just happen today then wait till late tonight or early tomorrow and check the icert website, because there's a delay when the data dump happens. Good luck man.

I am no real expert man, but from what I have gathered (from looking around and asking a few attorneys) that is probably the best course of action. It looks like if it's a different employer and preferably a "different" position (although that's not required I believe) that's probably the best bet, obviously we are in a altogether different year and so that also helps from what I understand. Obviously there are others who have gone through this well before us, and they might have more tailored info but that's what I have learnt.

Yeah Brady12 on that front I think you are wrong, Denied/Withdrawn cases do not immediately show up, it's only quarterly data and not part of the regular data dump that DoL does for Certified cases. Anyway, it's good to know about the FOIA request working in PERM cases for us to know what exactly they submitted on-behalf of us.

Atleast from dolstats website, to the extent I can see I don't see denied cases for last year and wonder if it's stale data as far as Denied cases go ? Like I had mentioned previously.

Nevermind, I saw that in the dolstats website but I thought someone had told me they don't publish that data or it's only published every quarter or something. I wonder if this denied list from that quarterly report ?

You took the time to search for someone else's case, kudos to your humanity. I also wanted to point out one thing though, yes it could very well be pending and and atleast there's a chance it's denied and the company/lawyer is not telling you. As we know the denied cases won't show up there in the iCert website(a cruel joke extended to the the maximum extent), unless the employer tells you there's no way on knowing, that is until the end of March when DoL releases their quarterly data for ALL decisions including, Withdrawn, Denied and Approved.

I feel for all of us man, I am waiting on my Oct '14 case and pretty much in the same boat. Anyway, there isn't much we can do right now, wait and also importantly plan for other options if at all possible.

Yes approval would be music to my ears and would be the greatest thing , but on the other hand if they are going to deny it , can't they be merciful and deny it sooner ? This is unconscionable what's happening with the DoL, there's nobody you can question this to and as a "foreigner" there's no recourse that's it stuck. Do the young ones in India understand, once all the flashy things about America wears-off , of making $$, only to know what a trap of an immigration system it really is. It's like a moth to a light, only the danger comes after.

Are you crazy ? I am sorry man, I mean that bill is going nowhere, and I think you shouldn't be tweeting anyone regarding that now because nobody cares especially in the heated Presidential season. If anything, the only thing that was somewhat hopeful was the rules that were proposed, and even that looks like it's a lost cause so far.

Do you know if there others in your company whose status are pending ? Denials previously ? Any approvals recently before/after yours ? I know sometimes there's no rhyme or reason, but we are just trying to figure it out, I never thought I'd be in this forum looking for answers like this, audit was never in my mind. Well live and learn I guess.

Wow I didn't know that there are people still waiting for Sept 2014 audit cases, that's depressing really. I thought whether that's an yes or no, you'll atleast get an answer, now they are almost finished processing Oct cases. Did you absolutely confirm with your attorney, that they received no response, denial ? If you did that, then I have nothing more to add, what else is there to say.....

I am going to apologize beforehand for a series of questions.

Anybody still waiting for their Oct 2014 audited cases yet, any good surprises late in the game so far ? Are the attorneys saying anything at all ? I am wondering if there's anytime limit for Audit response from DoL, I know there's no time limit for response for the regular application (before Audit), but is there one for Audit or can it go on forever as well ? Also, is there a way to know, how they are picking up the cases for Audit processing, I know the website says Oct but do they then go by the next sorting order of Audit Response date or is it just the individual officer assigned to the case ?

I mean the entire aspect of it is disturbing , I understand this agency is there to protect jobs for Americans but all it's doing is wasting tremendous amount time, without accomplishing the it's stated goal. Such a disaster.

Last week before the 25th holiday, I did see a lot of Oct 2014 approvals like in the 300 -400 range and after that it tapered.

Anyway, technically you are right, I guess there's still some chance but it's kinda dwindling. Where are you with your PERM, any info ?

I am waiting to formulate my comment based on feedback from different sources including IV, but please do take offense to my following statements. The way some of you have commented in the Trackitt forum is much to be desired, I really hope that's just because you type really fast and that you don't give much importance to the language unofficially, but atleast when you comment in the Regulations portal that you do so with due diligence. Some people "write-code", some manage people well and there are variety of talents for each and every person , so if writing is not your thing, please make sure you write it out clearly and do grammar/spell check and then post. Make sure it's clear and concise , and I disagree that it doesn't have to be emotive at all, but it can't be the focal point, I think a little emotion based on our family/children is good thing if you ask me.
