my wife's i-485 got approved today. mine (i'm the primary) is still pending although i had a soft LUD on mine today.

very excited and cant wait to see mine get approved.

unfortunately i have a busy day at work so i have to hold off on drinking a nice beverage to celebrate!!!

i think it is a combination of no more visa's being allocated until 10/1 (according to other posts on trackitt) and of course hurricane ike.

hopefully we'll see a flood of approvals on Wed/Thu/Fri including mine :)

Read your post and I think you need a lawyer to answer these questions.

My thoughts which do NOT answer your questions :)

Maintain a good relationship with prior employer and lawyer to extent possible incase of RFEs being sent to lawyer. Stay positive and keep looking for a new job, as obvious as this is, you can not let your foot off the pedal and you have no time for negativity. I have a few colleagues who were so depressed by being laid off that they were negative and have done a poor job looking for job and are still looking (we got laid off together a few months ago).

Rest assured that if you have a strong 485 application you should be fine. I read a post on Trackitt from someone who got a i485 approved in a similar situation so you should dig through Trackitt.

hey:

- the i-140 is NOT being amended. it is being left as pending. i am not familiar with this idea of amending an i-140. do you have any additional information on that? my prior employer will not withdraw my application so i am hoping my i-140 application is approved without any RFEs. my lawyers have said my application is pretty straightforward so i am hoping for the best.
- no amendment = no impact on i-485.

what is your situation?

all - i am in a similar situation where i am changing jobs with pending ac21. spoke to 2 separate lawyers who said much of what has been said here. no need to send a specific letter as there is no specific form for ac21. and letter will likely get lost or never get posted into your file.

i filed an h1b transfer which i understand includes something you check to let USCIS know that you have a pending GC. i am watching out to see if there will be an update to my file.

shivapb - i agree with you. the memo on page 9 clearly talks about "approvability" and says that if the i-140 was not "approvable" then the 180 days does not make it "approvable". i think that is the issue they were trying to address.

from having spoken to multiple lawyers about porting an unapproved i-140, my understanding is that it will not be an issue if your company is clearly able to pay (large company, etc) and your qualifications are transparent. these are the typical RFEs issued on a i-140.
