I have L1a, so had 3 years remaining. We asked for the 3 years and was granted the same.

We didn't put anything about overstay or unlawful presence as we had not overstayed beyond the 180 days (our lawyer confirmed this). Our I-94's were stamped 3 years from our date of entry. They do not back date I94's.

Just filed a new I-140. This application has gone to Texas, so I hope it stays there. So now the wait begins once again.

You should take your receipt number off the web, at least the last 4 digits. Protect yourself.

I wish you luck. Our lawyers have just refiled my I-140. This time non-concurrently. The application went in today. I believe that anything you send in an MTR that is based on their opinion and not fact, is a complete waste of time. We filed 2 x MTR's with lots of additional information, but their minds were made up and nothing was going to change it.

I asked the same question to our lawyer and she told me that it was fine. USCIS will look at the one year of employment before you entered the US, not in the last 3 years. In our case, that is exactly what they did.
