AC-21 Employment Letter Question
No they do not have to say that they do not have a problem with you continuing you GC (I take back what I said early because I just read my own letter)
Here is my letter if it would help (Greg Siskind is my lawyer and this is what they crafted)
I invoked AC21 with I140 pending and was approved, but my previous employer and current employer were very supportive and helpful. I guess USCIS accepted this letter in its format....I hope this helps.
On a side note when approaching these american employers it is best not to bring up immigration. When you start to work just tell them you need an employment verification letter for your residency purposes. THE WORD IMMIGRATION, GREEN CARD SETS OFF RED FLAGS. But if have found that just saying USCIS needs documentation on my PERMANENT RESIDENCE FILE to ensure that I am still employed and I am not becomming a ward of the state....BINGO....we are not using UNEMPLOYMENT MONEY...they give the letter.
ANYWAY HERE IS THE LETTER

RE: Employment of NAME as a POSITION
To Whom It May Concern:
As the POSITION OF PERSON DOING LETTER (OWNER, BOSS HR) of COMPANY NAME, I offer this letter to confirm our company’s employment of YOUR NAME in the position of YOUR POSITION.
COMPANY NAME AND DESCRIPTION OF SERVICES ENGAGED IN.
As a POSITION, NAME duties include the following:
LIST OF ALL DUTIES (MUST CORRESPOND TO LABOR)
It is my understanding that NAME duties and position with our company are substantially the same as or very similar to those he/she performed for his/her previous employer, NAME. His/Her extensive professional experience as a POSITION, in addition to his/her QUALIFICATIONS, makes him/her a great asset to us.
For his/her work as a POSITION, NAME receives an annual salary of approximately AMOUNT (GREATER THAN PREVAILING WAGE). His/Her employment with our company is pursuant to his/her Employment Authorization Document, granted as part of his/her pending application for U.S. permanent residence and valid until DATE.
If you require additional information regarding NAME employment, I am happy to be of assistance.
Sincerely,

AC-21 Employment Letter Question
I would say no because the offer letter does not confirm that you are employed at the company....that you are presently being paid wages above what is on your labor....and it does not state that the employer is in support of your adjustments.
Even though it may state that an offer is being made, the wages, and the duties.
Comments are welcomed.

Need suggestions on RFE( experience) please...........
GoodluckGC,
This is just a documentation process.....basically any body in an official capacity i.e. lecturer, previous supervisor, who could document on a company/school's letter head that you did some sort of project or work that would qualify the experience stated on the labor would be enough.
The key point is you need the 10months outherwise NCS will slaughter you case.
The experience must match what is on the labor.
It must be official....i.e. on a letter head, with the persons position, and their statement that they suppervised your work.
Talk to a lawyer and find out what documentation you could provide.
What did you do prior to the Masters...did you not work in your field at all.

anyone whose 140/485 denied due to change of company before 180 days
sonekapinjra:
The person asking the question is having a though enough time. Why do you so bravely make so many inaccurate statements? Get your facts straight before giving advice, this is a serious forum.
Q1: Yes she needs to have 180 days completed from the receipt date of the I-485. But the best thing per Murthy is to wait until the I-140 is approved and an RFE is issued on the I-485, and then invoke AC-21. A job with duties similar to what is on the labor has to be found before the I-485 approval. Also the salary has to be similar (some say within 10%) of what is quoted on the labor.
Q3: Totally baseless. The process is not lost once the I-140 is pending and the Employers attorney who is representing the case responds to all RFE's issued. If this occurs the I-140 process would continue.
GCwait1 please go to the Gurus. Just go to the most talkative on trackitt and you will find serious analysis on AC21, and several persons just like your self.
GAwait also consider that it will cost the old employer some $1500.00 and a six (6) month wait to withdraw your case. Your lawyer is correct. Relax.

Emilio ts gone !!! good or bad????
But I fear that the current Republican party will put some one in place that would divert attention on citizenship cases (for the election of course) and just forget about us.....after all all we do is pay taxes (sarcasm)....is that really worth anything.
Lets hope for the best...God be with everyone and their families.

I-485 processing date current, I-140 pending
Same boat ivandean....EB2....concurrent filer with priority date current and yesterday 03/03 I-140 got transfered to NSC. I know that at NSC current processing date for I-485 is July 30th 2007 while I-140 is lagging. So I called lawyer immediately, he said, my case is concurrent so this makes sense, and that in order for I-485 to be worked on they needed to ensure that I-140 is approvable. So I asked does this mean the I-140 will be approved....he said keep your fingures crossed....Lets hope for the best.
