Hi...
My interview was at SFO. My attorney asked if they will stamp my passport. IO said no as it is not the practice now. What they made me do was to sign on a strip and have my index fingerprinted. This will be used to produce the physical GC. He said I should get my card in the mail 4-6 weeks since it is processed in another center. The letter he gave was signed by the field office director (SFO) congratulating that effective today I am a permanent resident. |

Hi guys,
I guess it is my turn to say I am now GREEN :-) My interview appointment was at 7.45 am at SFO Waited for nearly 45 minutes. The reason why they want to interview me was for me to proof that I had not violated my previous J1 rule: I was on J1 under company training in 1998 for 10 months. I got transfered back to US under L1 in Nov 2000. They found that I had been back to US several times between 1998 and Nov 2000. I explained I was on a visitor B visa visiting my g/f who is now my wife. IO refused to approve on the spot saying he want to investigate this issue. I opened up my passport including expired ones, showing the various countries in Asia and Australia I have been travelling frequently between end 1998 and Nov 2000. He finally agreed this as valid evidence that will likely see my case approved but he still wants to investigate. My lawyer asked how long? IO said soon....My lawyer pressed on and IO finally gave in and asked us to go downstairs to make copies of my travel visa stamping. Came back and handed the documents. He confirmed he will approve my case TODAY. Handed me a letter and asked me to write a sworn statement giving all facts about my travel and that I did not violate the J1 visa ruling.
He handed me a letter stating I am a legal PR effective today and congratulated me. He told me my card will be sent to be within 4-6 weeks. He also stated he would like to approve my wife but her file is still stuck in NBC. Her interview is end Feb. He told me not to worry and reminded me that I should have all documentations when my wife interview later in Feb.
So guys....here I am now. no longer a legal "ALIEN"; no longer need to be hered to special room when travelling back on AP and being treated like criminals.
I have an attractive senior executive offer in China which I will take; which means I will give up my GC. My wife do not want me to move to China. My present company (been with them 12 years) knew of my offer and is now working with other senior VPs and will likely want to give me a different job/promotion to keep me. Let's see what it will be like. If it is good, i will likely remain in US>
Well guys, for those stilll waiting, just be patient. your time will come. I have been through hell for 7years to celebrate this day.

Topic: Maintaining GC Status
Hi;
My 485 interview is this Friday. I am expecting this interview to be a formality and per my company's attorney, I would be able to get my GC approved this Friday (based on his past experience), if not it will be within 2 months at most. Can anyone validate this information? My interview will be in SFO.
I have two other urgent question regarding maintaining my GC (assuming I get my GC approval this Friday):
Q1: Can I change employer immediately? I have been with same employer for the entire 7 years I am here.
Q2: I am in the final interview stage (reloc + benefits discussion) for a senior executive position (Managing Director) with an European firm and this position will be based in China. If I were to accept this offer, what will be the impact on my GC if I work in China but my package will be in USD and I still pay all US taxes and maintain my property and bank account in US? This job offer is too good to miss and it does not matter where I live/retire given the renummeration I am likely to be offered. It is just that I do not want to give up my GC after going through hell and stress these past 7 years.
Appreciate any comments/advice from gurus.....

Topic: Travel on AP - to Mexico
I was in Mexico on my 2nd honeymoon last year. All you need is original copies of your AP. You do not need 485 receipts nor EL. When you return, you will be taken to another holding area. The POE will want to see both originals (AP). They will stamp on one of the original and hand back both APs to you. Have fun in Mexico.... |

Arbee.. it is a long story on my case....got denied twice at NSC. I was promoted and my company changed my status from L1B to L1A. So we applied under EB1-C. THe reason was that we can take advantage of PP since my L1A expired in Nov 07. Also as a back up my company reapplied my LC and place any application under EB3 and filed concurrent 485 so that I can still be with my company and not leave US after the expiry of my L1A visa. Now my I140 under both categories have been approved (one at NSC - EB1C; and at TSC EB3). It is complicating and i think this cud be the reason of my interview. will keep every1 posted. |

My interview letter has a footer printed as Form I-129. It was addressed to my lawyer and cc me. The reason for appointentment box states: Interview on your client's application for adjustment of status. So yes, my company's lawyer will be accompanying me.
Did you have the same format in your IL? Was there a footer listing the form as I-291? I saw in some post where people had their 485 denied under Form I-291? Also in my interview letter, the following was printed in bold sentence...."Failure to appear or to bring requested items (original and copies) may result in the denial of your appication for lack of prosecution".
What does that mean lack of prosecution? Does your interview letter has the same sentence? This is freaking me out!

Thanks for your reply.....wish me luck. I will post details after my interview. My IL did not ask for bank statement so I am not going to give out more than what is asked..Besides I find it ridiculous for IO to review our bank statement.
To roxy...I do not have sublabour....I did have an arrest from domestic quarrel with my wife. We were both fingerprinted and locked in jail for 1 night. No formal charges, records expunged.
BTW, my wife is the beneficiary. Her case has been transfered to NBC. I am surprised her case was not tied/transferred together. Anyone in the same boat? Wife's application got seperated with no interview dates?
