I just read an article on Murthy stating "USCIS has been known to use an ever-growing number of publicly available sources, including internet sources such as Wikipedia."

Are they nuts?

Topic: painful situation

Just curious. So the IO at the border has no right to revoke I485, but you can't reenter the US with AP as the IO took it. In such case how does one maintain AOS pending status? If Faama reenters on H1B or other non-immigrant visa is his I-485 still valid?

Quoted in 2007. There was a notice of change of the fee.
So it must be higher now but I think it's still around $100.



Oops...it certainly included HIV test. This thread would be more useful if we share
doctor's name, location and the fee you paid.

I'm sorry to learn your situation. Perhaps you've done already but I would suggest you to call your lawyer who assisted filing the I-485. The immigration control officer should not have revoked I-485 just because of the Canadian PR. It looks to me that it's an abuse of the power.

Topic: I-140 filed without a LC hardcopy. Anyone approved recently?

Hi

this topic, I-140 without LC, comes up time to time. There are variety of reasons
why one cannot file LC at the time of filing I-140 such as lost in mail, substitution case etc.
In such case USCIS has to request a copy of LC from Department of Labor.

My questions;

1) Anyone filed without LC got approved recently?
2) If so, can you guess how long it took for USCIS to get a copy from DOL?

Isn't there an option to have a new H1B for backup with a potential employer
instead of transferring the current one?

If I recall correct the new H1B is not counted in the H1B cap so it should be
fairly easy to get one. If the current employer continues to hire you (and
if you are happy with them) you can stay with the current H1B and just
forget about the new H1B. In the event of fired, you can simply use the
new H1B and work at the new company, and don't have to worry about the $15k.

The possible problem might be is that you need to state how many hours you
work per week in the H1B application. 40hrs/week for the current H1B and
the new H1B application may triggers questioning. Please consult with a lawyer.

Topic: Queue is based on Notice Date or Receipt Date

some officers follow ND regardless the regulation. For example I went to infopass for interim EAD after 90days of RD. The officer turned me down right away saying it's not 90 days yet looking at ND which is about 1 month later then RD.
