Topic: How long will it take for Spouse Green Card after Primary is approved?


My husband just received the "Card Production Ordered" email this morning - however, my I-485 case has not been updated since our biometrics appointment.

Is there a general trend on how long after I should be expecting any updates on my case?



calicdn if i were you i would call uscis right now instead of asking the question here, ask them. if yours and your husband's paperwork was filed at the same time then both of you should be approved together. I would call the uscis and choose the option"you filed several related cases together and you received decision on some..." that will connect you to the IO. Funny thing iun my case, I filed for AP and never received the document so after two months of wait I called USCIS for my approved AP and they said that your CP is ordered. after this phone call my case status was updated on CRIS. try it good luck.

Topic: I-485 processing time for GC applied in EB1 May 08


Hi All,

Following is my case:

Current visa: L1-A
Category: EB1C
I-140/485 file date: May 06 2008
FP done
Got my EAD last month

Is there any way to get a tentative date range for my 485 approval? I cannot depend on the USCIS processing dates in the website since I have many friends who have got their 485 much earlier than the USCIS dates which are more generic

My wife is expecting our baby and will be in India till Mar 09. I want to be sure that our 485 does not get approved before Mar 09 and thats why I need help to understand if it is safe to assume that my 485 will be approved after Mar 09 so that my child can come back to the US with my wife on L2 visa



no if your child is born in india then you need to file AOS for him also. once your AOS is done, the existing visa is cancelled. in my view you are kind of robbing the child of certain previlages by having the baby in India.

10 days later got GC
on 15th day got my welcome notice
approval notice still missing and the HR wants the copy of approval letterr not GC, I hope it is not sent to some lawyer like my AP

Topic: We need to return I 94 and H1B Approval notice after getting GC?

i got my gc in nov, went to home country in last week of nov, did not submitted my I94 while going out, nor did i carry my H1 approvals with I94's. travelled with new pp nowhere in US i was asked to show my old pp while going out or old pp was asked when i came in. only the immigration at the home country asked for the old pp as teh new pp was just few days old.

You mean it is legal for those who are on EAD ? BTW, I am on EAD now. And yes, right now I am working in California. But my GC filing company is in Texas.



I was in CA when an employer based in NJ tried to make me sign a contract. When you work in CA, the CA State law prevails. Even if you use EAD and they make you sign a contract, it could mean trouble for the employer. Don't take antagonistic position eitherway.

I just learnt from my HR recently that there is a new regulation (?) that employer will be required to pay for GC. This is however unconfirmed.



WAI, yes the new regulation news is true and it was passed implemented in july 07. which is good and bad, good it will save some money for the candidate, however we are talking about indian run companies they will take all the money from you and then pay by their checks. or the terms of engagements will be justing signing off you as a slave forever.

starter you can aswk the company to put start and end date, you are ROW so keep the contract from back date.

nope they can approve the 485 as an approved 140 is there, whether visa is available or not is the second question. so you can go ahead and file the 485



Not true. The approved I-140 must also have current PD to get the I-485 approved. whether visa is available or not is the primary factor before I-485 can be approved. Let use one example: EB3 I-140 filed in 2007 (PD in earlier 2007) and approved already. Then in mid-2008 EB1 I-140 is filed and later I-485 is filed. The I-485 will be accepted because there is a pending EB1 I-140. It is not because you have an approved 2007PD EB3 I-140 so that you can file I-485. And the I-485 can only be approved after the EB1 I-140 is approved, or the approved EB3 I-140 reaches the current PD.



my understanding is the PD is only required for fiing 485 but it does not play any role in approval, after filing the RD plays the role in approval

Just to remind you you need seperate AP for each and every entry. since you already have filed 485 the CBP agent will ask for an AP, whether you have or have not stamped H1B visa on your PP.
