Here is my friend's experience ...
He filed in August 06, transfered to NBC in July 07, interviewed in Oct. 07 ..... then nothing happened. During the interview, USCIS took away their I-94, but did not stamp the passport or tell them they were approved. They waited, made numerous calls and InfoPass, only to be told everything is complete but no word on their approval status. In the mean time their H-1B was expiring ... so they had to renew (despite no longer having I-94). They initiated a service inquiry in March 08. Soon after that they were told their cases had been approved. At the end of March they received their cards ..... the cards says that they had been assigned PR status starting on Oct. 07 ... the day of the interview! So what happened to their cases for almost 6 months? Somebody just forgot to update the computer? |

Domestic violence conviction or arrest may be a misdemeanor but in some aspects of the law it is viewed as heavily as felony record. Example: firearm law. If you have a domestic violence charge/indictment or conviction in your record .... say goodbye to your firearm rights. Not sure how this is viewed in terms of immigration law. I am not sure if a domestic violence is classified as crime with moral turpitude. Some forms of assault is usually considered as crime with moral turpitude. So yes, you need a lawyer to thread through the interview in case they bring up your domestic violence record as crime with moral turpitude. |
Topic: Primary approved, but dependant pending. What could be the reason?
My family applications were approved in the same day they approved mine (I am the primary). This came as a surprise since our receipt dates are separated by almost 8 months (my wife and daughter filed their I-485 much later than I did). Now all our cases are progressing identically. Just received email for all of our AOS from CRIS stating that Approval Notice has been sent today (April 11).
BTW, we are ROW chargeability. |
Topic: I went Green a few days ago
08 April 08, Got an email from CRIS for Card Production ordered at 5:30 PM, followed by another email at 7:30 PM for notice sent, new permanent resident status registered. Two hours later got similar email for my wife and daughter. So we all went green.
Receipt date 04/12/2007. Got delayed by NNC, but thanks to the new policy they could process my case after Feb. 08.
When I did not see any movement in my case towards the end of March, I called the customer service. Got transfered to the "next level" and spoke with a gentleman (not sure if he was IO). He looked up my case, and said that my case had passed beyond the current processing date and he would issue a notice to Nebraska Center to expedite my case. Lo and behold, 2 weeks later I went green.
I still consider my GC as probationary until my NNC is cleared. But I have a DoD clearance for something else and I find it difficult to comprehend how my NNC would turn out differently. |

Nope, I never fill out an I9 form using my EAD. A few months ago when going through yet another FBI background check, they (FBI) asked me for additional pictured ID, since my EAD was the only additional pictured ID I had with me I showed it to them. Do you think simply showing your EAD as proof of identity will void the H-1B? |

I am currently with H-1B valid till 09/30/08 (first 3 yrs). I also have an EAD I received in July 07 just in case. I am still working for the same employer to whom the H-1B was issued by USCIS. Same position and job as in my I-485.
Recently I had to take a background check with the FBI (it is not related with my I-485 name check). I gave them my I-94 number, but they also asked me for my A# suggesting they cannot use my I-94 to check my immigration status. I am still talking with the FBI about this, mostly out of concerned that my I-94 had been voided outside my knowledge.
So what kind of actions do you do with the EAD that will void the H-1B? I thought the H-1B will be voided if, and only if, you use your EAD to work, no? Any thought?
How do you check the status of your H-1B anyway?
I am calling my attorney tomorrow, but any comment is most welcome. |

Actually, I have not used my EAD yet. So there is no reason for USCIS or ICE to cancel my I-94. ICE customer service is still closed ... :-( |

USCIS customer service confirmed what you said, the A# on our receipts and EAD will be used as the alien registration number once the GC is done. She gave me ICE number to call concerning my I-94. USCIS does not handle I-94 anymore. But ICE call center is closed today ... :-(
This reminds me what my friend went through ... he was transfered to NBC, then had an interview. All went well, he was told everything looks good, so just wait for the approval notice. And the IO who interviewed him took away his I-94. That was more than 1 month ago. He still does not have any approval notice and without I-94. H1B is running out .... but you need an I-94 to renew the H1B .... so he is stucked. So why do they take the I-94 away before the final approval is given? I thought it would be better for applicants to surrender their I-94 AFTER they receive the GC. That way, there is no confusion about their legal status. |
