Helo, sorry to hear about your situation. I believe you are well qualified, so there will be so many desi companies willing to do H1 transfer immediately for you. Make a deal to run payroll since you will be great asset to the company and try for some consulting opportunities, you may get somewhat less money or you may have to move around, which should be OK considering current job scenario. This is just my opinion. Wish you good luck.

Topic: I-140 Approved, now how long till I-485?

Anytime from now since your boyfriend's PD is current, there is no logic behind approvals. Check the processing dates, if you have passed (30 days?) processing dates for 485, your boyfriend can raise a service request. The only thing you can make sure from your side - all the checks (security checks) are done or not. Good luck.

Topic: pls advice me on this urgent situation

As far as i know you can call USCIS regarding your AP after 90 days. So just call after Dec 5th and ask them to expedite your application. I believe you are very close to getting approval, for me it took almost 90 days, so don't worry. Good luck.

sodeep, if you are not the primary applicant for your GC, you are OK, your status will be adjustment of status. Please put your details in Tackitt, so that members can give correct response to your questions. As far as I know you can not apply for employment benefits.

As far as i know (from this and other forums) cross-country chargeability applies when you or your spouces (may be primary applicants parents - not sure about parents) country of birth falls under ROW category (it doesn't matter who is primary). Please do a search in this forum - i am sure you will find valuable information.

It applies to all categories.

Anyone please correct me if i have provided wrong information.

You are in ROW category and priority date is current. EAD and AP extension might be waste of money, but it depends on your comfort level with current job, the job market is not so good. EAD and AP extension will be very useful if you loose your job. It depends on what situation you are in. If i were you, i will go for extension to have piece of mind.

Mickey, i believe she can go back to H1B as far as i know (need not go out of the country as long as I-94 not expired). Spefic details regarding this - i don't know. Talk to very good attroney ASAP. What is the reason for 140/485 denial? Best wishes.
