hi,
same issue with a slight difference... my i94 and h1 expired couple of months ago... and i have been working on EAD and do have advance parole since then... do i still need i94 or another question would be that should i be getting an i94.
I have not travelled to india since my h1 was expired.

I had a soft lud on 5/1 and the on 5/3 got an rfe for my son's birth certificate...
responded with docs and birth certificate translation...
Let's see what happens, as per other post in this tread i feel i might get a second fp as mine is more than 15 months old.. .

After going thru the post.. i was compelled to mention.. The H1B issue started when microsoft announced laying off 10000 people.. and not when bank of america asked for bailout money... Microsoft is the biggest us firm to use h1b program...and the point is if they have to lay off ... start with h1b's...i don't disagree to this concept...
The issue was then dragged to be implemented asap that's how it has made it to bailout plan....:) |

nope... unless your 485 is denied and you stay longer then the notice period to leave the country.. you will be good..
drawback certainly is there ... you will have to quit working during the gaps.. and that is legally fine... |

Your legal status would be adjustment of status on pending 485. With EAD you are allowed to work till expiry. And further till your renewals allow till the time your 485 is adjucated...
In the mean time you can fix your other issues. There is nothing to worry about... |

I do not think you can change jobs with i140 pending.. it has to be approved along with valid ead 6 months old... for your to use ac21 portability...
Check with laywers first before you commit anything with client...

According to the memo being unpaid during the renewal break is good... that does not harm...
Probably you can still work and not get paid during the period or get paid once your renewal is in... that would work good for your if your employer co-operates... |

I had this issue a few days ago.. my ead expired on 14th , when i had my renewal it was issued with the date it was approved... and that was 20th... There is no continuation in ead renewals and during that period you cannot work...
