It is possible. Some cases I have heard is like for TB testing if at the time of applying wife was pregnant and could not take the vaccination at that time etc. |

Hi kmpate. Did they ask for your I485 receipt? I am in the same boat, so wanted to know docs they need if I need a DL renewal , given my H1B does not have more time.
Yes He made me bring the 485 recipt and they need the original. I had scanned copy which he accepted but to be on the safe side have the original.
Also when I showed my ead with 2 year he bluntly said recently they don't look at the ead date but you need approved EAD with valid date and he will extend by 1 year only.
When I asked how do I renew next year since I will have the same EAD he said bring the exact same docs and he will renew for another year.
This is a new office thats opened in Easton,PA. Allentown office had not asked for any 485 recipte last year (airport rd) |

I just renewed by DL in PA state. I was hoping to get 2 years licencse since I got 2 year EAD but apparantly
DMV does not care anymore about the EAD and goes by the 485 reciept.
Bottomline: I just got 1 year DL even with 2 year valid EAD.
Has anybody got 2 years DL with the 2 year EAD? |

By law they are supposed to give or reject EAD in 90 days so you could take them to court. But if they asked for some additional evidence and you sent them then the counter for 90 days starts from they recive you reply. |

You are very optimistic in your calculation.
Unless the law changes or you are lucky that your application gets picked up when dates get current
even with 2004 pd it may take 4-5 years for EB2 India.
Consider yourself lucky since your labor got approved in almost an year.
we had to wait almost 3 to 4 years just to get the labor cleared.

I think we need to file protes or write to senators to fix this issue.
If we are allowed to work with pending H1B extension then the license should be renewable on that basis. |
Topic: I took infopass for 90 days-delay
I pretty much tried every possible option. Again not to be pesimistic but just letting you know what happened to my case. Each case is different and god only knows why some get approvals soon and some don't. I wish you good luck.
Called USCIS and opened a Service Request as case was pending fo more than 90 days and USCIS denied request
Went for Infopass appointment
Sent a fax to expedite informing EAD expiring in few days and USCIS sent letter informing request denied
Called Congress man's Office. They said they can't do much as processing date was 5/1/08
Sent a request to USCIS Ombudsman and they replied informing they will follow up the case.
Still waiting for the card. EAD expired and i am on leave of absence.

You should tell them they are leagally bound to give the EAD in 90 days whether or not what the processing date for them is.
Just tell them this bluntly and also tell them this is required for you Drivers license.
They will accept the expedite case. They did in my case and seen some luds on my case. Waiting for the approval |
