Hi sonu796, in that case they would not know you no longer work for the same company since EAD is not attached with the present employer. But while approving for i485s sometimes they decide to check whether the person works for the same company or not and may RFE on it, but that is not because you have switched jobs and RFE is generated. I think it is just random in that case.

Once the green card application is in and PERM is approved, one can apply for EAD. If 140 is approved, one can apply for extension of H1-B as well. i140 is still current employee based, if one looses his job while i140 is pending, the company can revoke the i140 application, in that case it is bad news as this makes the green card application to stop. But not all companies report and do this, and this can be negotiable. If the company did not revoke the application of i140, then one can find a new job on EAD if the i485 application is pending more than 180 days.

And yes, he can apply for EAD after loosing a job, because EAD is related with i485 and it is about future employement and does not have anything to do with current employment.Because with more than 180 pending i485 one is able to switch jobs on EAD. Although it is usually discouraged by the lawyers if i140 is still pending. Because the company can revoke the application for it in the case of job loss. But if they did not revoke it, and one lost his job, then on EAD and more than 180 days pending i485 one can switch jobs, no problem there.... Hope this helps.

Yes, buster it is legal. Because EAD is given for the future employment opportunities unlike H1B which represents your current employment. That is why if one looses a job on H1-b things are more complicated.

I may loose my job soon during this financial crisis since I am in finance industry, and my company is struggling. I have a 2 year EAD approved just recently, and I-140 is also approved. My I-485 has been pending more than 180 days. How soon do I need to find another job if I loose my job? Am I eligible for unemployment in my situation?

Please help... Thanks for all your help in advance!

Hi, my case is very similar to yours. And online it still shows it is pending. Aren't the lawyers supposed to let you know though if an approval of a case happened?
