Have Faith Bud. I am in the same boat with PD little later than you. Only thing that keeps me going is the possibility of some rule passing. I feel like leaving lot of times but then I never want to be in a position where I would possibly regret any rash decision in case something favorable passes in future. If we go purely by the numbers that I don' think there is any hope for next 15-20 years.

Hi All,
I am currently on H1-B with approved I-140 (PD early 2012). By education I have a masters degree in computer engineering (from US university) and I have been pursuing further education from past few years. By the time I am done next year I will have 3 masters degrees (MS in Engineering, MBA (dual major in info systems and finance) and MS in information systems).
Is there any way that I can file 485 in any of EB-1 category with 3 masters? I have been making a constant effort to make publications and journals as well.
I understand that its a long shot but I would really appreciate any inputs here.

Thanks a lot for your inputs curidpostn, do you know how often can they visit on tourist Visa. Can it be done very year for the period of visa validity, also how long can they stay on 1 visit and how long should they wait between two trips?

Hi All,
I am on H1-B with approved I-140. My PD is May 2012 and looking at current scenario it will be a long shot if I get a Green Card in next few years.
I have a stable job and I am really happy with my employer, my greatest sense of guilt comes from leaving my parent behind in India (which I am sure is the case with many of us) and like most of us I am in the quagmire of choosing between great career and family.
I just wanted to check with experts and see what options do I have so that I can keep my parents along side me atleast for some time during the year. I do understand the tourist visa is an option but is there any other option? Since my parents are retired can they be treated as my dependent?
Also, what are my options after getting a green card.

Would really appreciate any inputs here.

Agreed, it is something, but still you are subject to restriction like your Job responsibilities must be same if you do intend to exercise this option.
Looking at current GC backlog I would take this. Between introduction of Filing date and this new rule there is some hope in an otherwise hopeless situation.

Hi All,
I have been following this thread regularly and have a question:
Per my understanding, proposed I-140 rule allows us for indefinite extension to H1B till your dates are current.
My PD is in later part of 2012 and I have an approved I-140 with my currently employer. If this rule does go into effect then would I be able to leave the country for few years and then comeback on H1-B and file for an EAD when my dates are current.
If yes, would I still be subject to yearly H1-B cap?

Would appreciate any thoughts on this.

Thanks a lot wardoma, really appreciate your inputs. I do have one follow up question and pardon my ignorance.
Per your reply below, how can I be eligible for EB1. I did not come to this country as a manager, my employer hired me as a technical resource but I had put down multiple promotion opportunities fearing that it would affect my GC process as a EB2I filer.
I do have 2 masters degrees from US universities and about 9 years of work experience.
Again, pardon my ignorance, I am in same boat as many of us and just got excited with any prospect of porting to EB1 and just want to make sure I dont miss out on an opportunity if there is one.

Hi All,
My PD is early 2012 and I am hoping to be eligible for EAD in next year or so (fingers crossed).
I have few questions about my option after filing 485 and getting an EAD:

1. Can I get promoted with additional responsibilities to my job, for example if I work as a developer can I be promoted to manager (managing a team of developers).
2. Can I change departments in the same company I am employed at, for example if I am managing some applications for sales, can I move to finance if I am managing the same applications.
3. Can I change my locations for example can I move from New York to LA while being with the same company.

Would really appreciate any insight on my questions.

Completely agree, just like most of us I would directly get benefitted from H.R 213 but judging by the way things went with CIR and other immigration bills in past I am not too hopeful. I feel that 'EAD for approved I 140 ' has a much better chance of becoming a reality than any kind of immigration bill.

Hi All,
I am in 9th year of my H1-B visa and my current I-797 started in Dec2013 and will end in Nov 2016. I am planning on going to Mumbai Consulate for my stamping and I have one question abotu form DS-160:

In DS-160 we are asked to put our current and mailing address. Should the current address be the address in US or the address in India?
Also, my address in India has changed since my passport was issued, will this be an issue?

Hi Gurus,
I have an approved I-140 with pri date of Nov-2011. I have two questions and I would really appreciate any directions that you could provide.

1. I have been looking for other positions at my work and I am getting some really good opportunites, would it be advisable to change my position even though it is with the same employer.

2. I know it is a long way to go but I would really appreciate any predictions on how long would it take for me to get an EAD and also can I change my position after getting EAD even though GC is not approved.
