cool. thanks a lot. i agree with what you say - havent done anything wrong. i have plans to go home for xmas. i have valid h1b, valid AP and was surprised by the GC approval.

i will make sure not to use H1B when i come back and show them AP + printout of my approval notice and then can do whatever they want. i'm an LPR now, so i have my rights that cant be taken away from me!

plus i am sure New York POE officers have good experience with this and it wont be a big deal. i'll post how it went when i come back

i just dont get how this could be an issue. say i left for poland yesterday and got approved today - not my fault that i was approved while outside of the country for a xmas break travel...

and here goes a good discussion about this. just make sure not to use H1B

i cant postpone, i already did so for a few days due to work and there are no seats left.

i got the advice from a very good lawyer. what could be an issue? could you please point to where this was discussed?

here's what my lawyer said:

"You should reenter on the advance parole, NOT H-1B. The officer should pull up your record which will show your permanent resident status. You can inform them that you received notice the day before your travel. Generally they would want to see an I-551 stamp (temporary evidence of permanent resident status) in your passport, but as it generally requires scheduling an appointment with the local district office of the Service with limited exceptions. It is unlikely, but the officers could choose to allow you to enter with a "deferred inspection," in which case they will hold your passport and schedule you for a date to appear with your permanent resident approval notice (welcome notice), or permanent resident card to complete the admission process."

couldnt believe my eyes when i woke up today and saw my CRIS email! 'welcoming new permanent resident!'

it only took one day after my i-140 approval. thank you all for support and help during the wait time. this website is an amazing place - hope all of you get green as soon as possible!

i was supposed to go to poland yesterday but had to move my flight to tomorrow due to work... i guess now i'll be going as a PR!
