U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2014. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption. After today, USCIS will not accept H-1B petitions subject to the FY 2014 cap or the advanced degree exemption.

USCIS will use a computer-generated random selection process (commonly known as the “lottery”) for all FY 2014 cap-subject petitions received through April 5, 2013. The agency will conduct the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected will be part of the random selection process for the 65,000 limit. Due to the high number of petitions received, USCIS is not yet able to announce the exact day of the random selection process. Also, USCIS is currently not providing the total number of petitions received, as we continue to accept filings today. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.
USCIS will provide more detailed information about the H-1B cap next week.

Topic: Travelling to US on H1 with Wife Pregnant into 14 weeks

Better you take when you are in India if possible. PPO is the best. I recomnend you to travel together and preferably stay close to someone you know here. Relatives friends coleagues etc..i assume you are travelling first time and you dont have lisence to drive here. That way someone can help for 1-2 months. Afterwards you will know everything. All this effort you take now will pay you when you had a citizen :-) good luck. Take 1 stop flight

She is still in 14th Week, that's the good part. you don't need to disclose to anyone unless if someone ask. 14th week pregnency travel is absouletly fine but i recommend not to take non-stop flights.

Regarding your Insurance questions, the best to answer those in your case is your employer. Usually for pregnency the insurance providers will cover pre-existing, but once again it really depends on what coverages your employer is providing.

It's not a big deal to find the doctor's especially when she is already pregenent she will have priority than new patients in getting appointments. this is not at all a problem. But be sure to carry all the reports before you visit the doctor.

Last year they accepted until the 11th April, which is pretty fast compared to previous years (2008,09,10 and 11). So i think it will exceed the cap by April 5th going by the trend, improved job market and economy.

$985 is not that bad. I would recommend you go ahead. but someone who said got their h1 receipt numbers are all Bogus. atleast no one will get from the 2014 quota until it actually starts.

Reagrding Premium processing, You can also activate that in a later stage once your application is received by USCIS and it is ACCEPTED under the quota. Bottomline is by doing premium dosen't entitle to consider you under the quota. It's just a way to speed up the process which was accepted. Hope you understood now.

LCA usually takes 4-5 business days only. worst case 2 weeks (10 business days). This year the h1 window is open from April 1st- April 5th. (aussuming the CAP reached more than 65K) otherwise USCIS will continue accept the application until the quota is filled. So you have time until the 5th of april to reach the application to USCIS. education evaluation can be in a day or 2. It's not a big deal. It's upto you now. The worst case is you would loose your attorney fee. Usually it ranges from ($500- $1000)

What anyone can do if you HR or lawyer is not responding. In your case there is nothing much you could do. Just get a confirmation weather they applied the LCA and have done the Education evaluation. These two steps are mimimum things that are done before actually filing the H1b on April 1st Week. Let's assume they haven't got back to you, but they did applied your case and it has been ACCEPTED in the 65000 quota, then you will get a RECEIPT number either from your HR or Lawyer. that confirms that they have applied. You can always track the status of your application using that receipt number.

You can apply anytime and you are no more linked to the quota. That means, if the 2013 quota is over you are still eligible to apply for a new H1. Since you already completed 6 yrs. Anyone who applied h1 and approved they can always apply antime without quota restrictions. Hope it's clear now. BTW if you apply and approved you are now eligilble for 6 more yrs
