Topic: Approved Labor amendment

My labor approved in June 2007, and i applied I140(EB2) on that labor in july 2007. It got denied in may and i appealed in July. Can i apply another I140 on the same labor now in Eb3. Some people told me that i can not because, it crossed 180 days after labor approval. Please clarify.

I am starting this thread to discuss the options for approved labor amendments. My EB2 I140 got denied on 5+2 year degree. and i appealed for that. but i don';t have any hopes on getting that cerified. So i am planning to amend my approved labor for EB3 positon and apply fresh I140 on that. Is there any body done that before. Please let us know the procedure and how long that amendment takes?

did they denied you appel because you applied another I140? Or just they denied normally? Because the appel queue is there for 12 moths, how come they opend your case in 3 months?

Hello nancy when did you file your first I140. Labor is valid only 6 months. So your I140 got denied with in six months. Is your Labor is for EB2 or Eb3. Iam also in the same boat. My I140 denied and appealed last month. Can i also apply anothet I140 in eb3 on the same Labor. Please advise.

I don't think one can file deined I140 again in Eb3, if it cross 180 Days. Only option is to file MTR, and file a new Labor.
