My question is I got my I-140 approved with employer A. I have since then moved on to employer B. I have completed 7 years of H1B. Will my wife be able to apply for EAD based on the previously approved I-140? Please advice

One more question

My H1 with current employer is until Feb 2015. So when I move to Employer B I will get 3 yrs from the date they apply right? What are the chances of current employer withdrawing the GC?? That's my major concern.

I have I 140 approved from Employer A just a month back. I have an offer from Employer B. Please advice regarding any pitfalls involved with this.

Will I be eligible for 3 yrs of h1 extension?
Is there a possibility that Employer A can withdraw my GC application?
Employer B can they start the transfer process with just the copy of current h1 and I 140 documents?

Any advice in this regard will be greatly appreciated.

Kartiksubbu is right. You have to take into account if it goes to an audit. I had the same case but just luckily needed 30 days recaptured to qualify for the 365 days rule. My case is still in audit, it was filled in Feb 28 2013. You may have to change to a F1 or go out of the country and get the H1 after your 140 is approved. For the F1 the same rule applies, you need to have the EAC number for change of status before the H1 expiry date. Do not wait until the last minute to file for F1 if you have to.

Before filing the H1 be it a transfer or extension, LCA needs to be approved by Dept of Labor, if you have the LCA the process won't stop since USCIS is fully functioning.

Please advice. My H1 expired August 22 2013. Employer recaptured days until Feb 2 2014. I am forced to go to India to recapture more time since my perm was applied during the sixth year (Feb 28 2013) and it went into audit this September. Am I eligible for Dropbox, I am with the same employer and FTE.

Hi All,

I am forced to travel to India, my perm was applied on Feb 28 2013. My H1 expired Sep 2013 and company is recapturing the days I spent outside US, that gives me until Feb 2 2014. Unfortunately my perm has gone to audit Sep 19 2013. I have go out of US for 25 days so that I can qualify for a 1 yr extension after Feb 2014.

I should go for stamping for my recaptured days, will I qualify for the visa drop box instead of the interview? Please help any advice would be appreciated.
