There was another similar Bill introduced about 2 years ago in Jan 2015 (H.R.213 - Fairness for High-Skilled Immigrants Act of 2015). It has not moved forward to the House or Senate despite having close to 150 cosponsors!
So please expect miracles to happen to keep the hopes alive!




Last time (2 years ago), this bill passed house with overwhelming support but was blocked from going to floor in the senate by Senator Chuck Grassley. Guess who is chairman for Committee on Judiciary (immigration subcommitee)? Chuck Grassley. He has power to not even come to vote.

My wife got EAD in 2015 and now renewal coming in 6 month so i am preparing for it. How much H4 EAD waiting time for renewal if we apply H1B, H4 and H4 EAD together in premium processing? anybody has any experience?



Can you provide an update on your experience with filing the h1b extension + h4 + h4 ead together? Did you file under premium processing?

I see neither a valid case nor a true 'racial discrimination' complaint. The person probably needs some sort of workplace sensitivity training and in treating others with respect.
I deduce the interview wasn't a pleasant experience due to the interviewer's lack of soft skills (probably in communication, interpersonal relationship and other allied areas) but I don't see the validity in interviewee blowing this up to a 'racial discrimination' charge based on what has been stated and revealed so far.

So are we getting thrilled for clarifications and confirmations here?? Guess we have ended up being the desperate ones after all the (non) administrative capabilities of USCIS.. Guess that is why they just put it as Clarifying or providing clarity. If that is the case why do they even need a rule?? Calling it a rule is a shame. Whom are they clarifying these for?? Themselves??


yup. unfortunately, for the most part it's for themselves (adjudicating officers) and immigration lawyers.

I am surprised that people are finding these to be something new. In fact, they are not and have always been there. I would imagine they are explicitly stating it but going from developer to a manager and being considered in the same job or occupation was always there and was part of natural career progression. This was made clear to me by Fragomen when I did my PERM and EB filing and not having to start the whole thing again. I have several people in our company who have done this without issues. Why are we going gung-ho about these?? Maybe I am lost here.



that's correct. natural progression was permitted even prior. Except that it wasn't stated explicitly anywhere. the whole point of this memo is to clarify all such points. Nothing new here except clarification and confirmation of what was the accepted norm in processing cases.

Based on latest stats on DOS Visa allocation numbers for FY2015, EB2I totals for FY2016 might be in the range of 7k-9k. About 3-4k would have been assigned to EB2I so far in this FY. So, another 3k-4k left as SO allocation. I don't see the actual dates moving past July 2009 this year.

No, this schedule J requirement does not mean what you are saying at all. The schedule J requirement is asking for official attestation by current or new employer to what was the previous (what was prior to this requirement) underlying implicit declaration that the employer has full time employment position in the same or similar job classification at the future date of issuance of GC (i.e. it is a permanent long term full time job)

if you have an approved I-140 for more than 180 days, you may port to a new job yet retain the PD with the assumption that the new job is in same or similar occupation. The new employer still has to file the perm and get a new I-140 approved but they can file with the old PD. So, you can retain your position in the GC queue.

But in IMO, this schedule J is just more paperwork for employers and applicants.

You should be working for the sponsoring employer at the time of approval of AOS i.e green card. So, you cannot be without a sponsoring employer. you may port to an another but not be without one.
You may pursue your business opportunity as an additional job on the side i.e. only if your employment contract with your full time employer permits you to do so. (most contracts forbid you to work on the side while working full time with them although extraordinary arrangements could be made by negotiating if you are a valuable employee)

We were supposed to be at this inventory level last year. FY 2015 is supposed to have cleared the 18k inventory. That hasn't happened. it almost seems like a case of missing year for EB2I.

There has hardly been any clearing of the EB2I backlog. Looks like a lot of porting activity into EB2I. Also, sense that the spillover has been far smaller this year.
