Hi,
I am working on H1 for Company X. My I-140 is approved and I-485 is pending for more than an year. My wife is currently working on L1B visa for company Y. Both of us have valid EAD.
My wife is now planning to join a new company Z on EAD.
Q1. Should I still apply H-4 for my wife? Is it possible to apply for H-4 while working on EAD?
Q2. If my wife quits her job on EAD, should she leave the country immediately to get a valid H-4 stamping?
Q3. If my wife quits her job on EAD, Can she rejoin Company Y on L1? If yes, should she go out of country to get her L1 stamped? |

EAD is not required if you do not intend to use it. But since you already have one (without using it), why not renew it |

If you have a valid H1 petition, you can get it stamped in India and return back. Not having EAD/AP will not affect your pending I-485 |

If I have I140 & EAD approved.. and want to shift to a new employer.... should I always use EAD or can I still transfer my H1.
In case I do a H1 transfer, will it affect either my approved I140 or pending I 485 applications? After shifting to a new employer, can the previous employer revoke I485 application? |
