Topic: EAD for H4 Visa Holders

Sorry If my post caused this confuse because I have posted two different things together. First line was to convey that I re-signed the online petition.

Second line was regarding the phone call from Representative office, it is a follow up action which is not related to the online petition. Two weeks back I met our Representative in their office and handed over our request. Our Representative did asked two questions which I don't have answers yet. When I met them hey did not promise me anything and just told me that they needed time to look into my request. However as promised they promptly called me and left the voice message asking me to come back to their office.

Thank you SS75. I also signed the petition. Just want to keep you posted, received a call from office of Representative. They left a voice message to my home number asking me to comeback to their office regarding my request on EAD for H4B. I was very surprised with such quick reply. I will keep you posted after I met them in the office.

Thank you for all your continuous support. Don't deviate and take the offensive path. Let us continue to focus on what you all are doing till today. There are many great people in the forum (as well as outside of this forum) and they all will continue to do their best to get the EAD for H4 done sooner or later. Let we all focus now to get the things done in positive way.

ss75 and GM08 : Thank you for your Suggestions.

ss75: I don't think we can give this straight numbers like this, as there is no document to support our assumptions (All H1Bs are not married, and not all H1B dependents are in H4Bs). But, thank you for your numbers.

GM08 : Thank you for detail explanation. I dont think we need to answer them with a specific number, if we tried to do that, it will be a mission impossible task. I am more of providing answers with some number range (example something like 1,00,000-1,50,000 etc.). But even to arrive this number and number range we need some experts insight supported by some links. Tricky question is how to get the number per state or per area. After I met the representative, I had a discussion with the law student who is helping me from the beginning with all the coordination. It is her assumption that "if this numbers are significant then representative may be interested to help us considering his long term benefits in terms of votes". Hence she asked me to do diligent work while determining this number. She also advised that if I can get the numbers and if those numbers are significant, then even senator may also show some strong interest. (Our surrounding areas have significant number of legal immigrants, something like one among the highest legal immigrants in the country). It is interesting to find that everyone looks for their best interest, may be that is the way politics /administration works.

My friend (law student) is no way expert in this area, but upon discussing our case with in her circle, she cited that we need at least few congressmen to support who can even write or push the administrative fix. With most optimistic view her group advised me that if we can get push from 4 to 5 senators that will sufficient to push this fix.

Let see for next few days as what other suggestion/ advices this forum will provide on this question.

Topic: EAD for H4 Visa Holders

Hi GM08,

I did meet the House of Representative and had a chance to discuss and present our H4B issues for up to 4 minutes. Our representative and his office team (not sure about their roles) but two of them were sitting in the room when individuals like us meet the representative. He knew little about H1B visa (His understanding of on H1B was, we are legal immigrants with STEM education) but he does not know anything about H4Bs. First two minutes were spent explaining him on H1Bs and H4Bs and the third minute was more about explaining our core issue as why H4Bs cannot work and handing over documents including all the 5 Unified Agenda and Regulatory Plan RIN: 1615-AB92 ( )

I wanted to explain how other work dependent (like L1 dependents) are allowed and only H4Bs are restricted. However my time was up and he had some questions and needed me to answer them. The meeting was more of providing information and answering the questions. He has not promised any action and told me that first, they thoroughly investigate and understand the issues before his office make any comment on our request. When I ask how much time it takes, he told his office will inform me on this. All together it was a mixed feeling for me. But I have not lost the hope or confidence, he seems to be responsible and he may get back to me. Now I need to see where I can find the answers for hos questions? (If at all if this is possible).

The questions he asked were how many H4Bs are facing this issue? He asked how many in our state have this issue. I told I dont know and we cant get such numbers. May be USCIS has that, but we dont know. Second question was, on an average how long (years) H4Bs will wait before they get the eligibility to work? Again I told it varies and I dont know the answer. I was trying to explain as it is not easy to find the answers but my time was up. Before I meet Senator I am trying to see where I can find the numbers for 1st question? For second question, I dont know if there is any number exists.

Lingopingo: Thank you for sharing OMB dedicated line: 202-395-4790. I will be glad to request the representative to call OMB and find the reasons for 3 years delay and speedy turnaround of the rule change. Also include this in the cover letter as well.

Trishona : Yes I will request them as all H4Bs (not limiting the 6 years rule). However not sure if this representative is entitled to suggest changes to the rules set be other agencies. Irrespective of this, I will request EAD for all H4Bs.

Just in case if you want to know how to schedule the meeting with Representative \Senator: Follow this below three simple steps,
1. Google your area name in Wikipedia and usually it has the name of Representative \Senator. And at the end of the Wiki Page usually it has links to individual Representative \Senator. Click on it.
2. Open the website of Representative \Senator there will a link called " contact Representative \Senator" click on it.
3. Once the page is opened, you need to fill the required information like name, contact details, purpose etc. (our Senator site asked me to choose the subject and I selected the Immigration").

You will be surprised when you get a email confirming the appointment date, time and venue. I was not completely confident hence I was not serious while entering the data!!! . However after I received the appointment, now I am planning the next steps.

If interested, may be it is worth give it a try. All though outcome is not certain, with fair hope, we all still need to take some actions like how many illegal immigrant advocates meet the representatives and build the momentum, we all need to replicate the same at some point of time, if we need to build the momentum.

Thank you for sharing the link. I found that many of the points discussed in the link are best points to be included in the cover letter. For the benefit of all members, may be it is worth to post those 10 identified points in this forum as well. Need to contact the original author "pinky6jan" to get her permission to post them in this forum. Regarding Representative I may not be able to ask "why they have not made any progress...." Instead I certainly bring him to the attention of "NPRM 30 days rule" and in spite of this rule EAD for H4B has been struck from since 2011.

Appreciate your feedback again. Let me know if you come across any additional supporting points.

Topic: EAD for H4 Visa Holders

Hi Guys,

Thank you for each one of you being positive and keeping this forum active. Finally I got an appointment to meet the Representative (belongs to where I am currently living) on 2nd week of Jan 2014. This is being first time for me to meet a Representative in person, I am kind of nervous and wants to be prepared. I want to request this respresentative for approval of DHS/USCIS rule 1615-AB92 - Employment Authorization for Certain H-4 Dependent Spouses . I will be carrying all the past rules and have a question on what other documents (Either copy of Petition or Request letter \cover letter etc) which I need to enclose along with the copy of rule 1615-AB92?

This is being my first visit, besides handover the copy of the latest "Rule 1615-AB92" can we handover at least one-two page of "Request Letter\ cover Letter" explaining what challenges our families are facing and what actions "they specifically need to take" in order to pass this rule. If any of you have already met a Representative/ Senator in your respective areas, please share your experience as well. If it is not yet done (one-two page of Request Letter to Representative/ Senator). Are there any volunteers who can draft one or two pages using the Petitions developed by krapzed / lemchang101 etc. (krapzed - lemchang101 -

We want to ensure that while we approach our Representative, we all will carry the same request letters\Rules which provides them specific action item on which they need to act upon in order to pass this rule. Any suggestions on this approach is appreciated. Again we are being small group (H4 visa holders group requesting EAD) we need to specify "one\two" specific action item for our Representatives which can be later tracked (I came to know that we can do a follow up with our representative after we met them on the status of our request).

If you have already been with this exercise in the past (meeting Representative/ Senator) please share your experience as well. I am also working towards getting an appointment for Senator but I yet to hear from his secretary.

Thank you again for all your support and please do suggest me with any best process "that can make an impact with the Representative/ Senator".
