Topic: Where's the plan for expediting legal immigration??

I would push for making every one illegal except for the native American Indians. Force every one to go back to their own country of origin. If they dont remember their country of origin, they are frackin out of luck and will have to apply under asylum. Then we will have an orderly system to bring them back in ... the line will be long ... atleast they will then follow the "letter of the law"... frackin perverts

Topic: H!-B renewal cost with 140 approved

Under current regulations, the costs and fees, including attorneys fees, associated with obtaining H1-B status cannot be paid by the H1-B employee if that payment would reduce the employee’s wage below the actual wage or prevailing wage (whichever is higher). In other words, if an employer requires the employee to pay the expenses associated with obtaining the H1, those costs must be deducted from the employee’s wage to determine whether the employer is paying the higher of the actual wage or prevailing wage. In addition, the attorney fees can not be deducted from the employee’s paycheck.

This is wrong ... The sponsoring company should be paying up the costs of filing and extending H1B and not the employees. They are legally bound to do so, asking an employee to pay for these costs would be a violation and will attract penalties.

Do you really really think that they would? I dont doubt there might be a few who are dedicated to their USCIS jobs but I dont think they are that "dedicated" to carry box loads of case files in their cars/SUVs. USCIS may have a system where they scan incoming applications so that they can be accessed from anywhere, but I would hate to think that they would really allow anyone to access these systems from a remote location. Too scary to imagine that system getting hacked and the tons of info lost.

I think you should also get in touch with the ombudsman. This is exactly the kind of case they are looking for. The ombudsman will follow up regarding your case with the USCIS directly cant get better than that.

You should have no problems what so ever. It is actually wise of you to get H1B stamped and use it at the port of entry instead of AP. I was in the same situation and I got my H1B stamped at Mumbai. It literally took 10 secs.

I believe that you can work. The new replacement card that you will get eventually will probably have a retro date from the date that the old one expired. Just have copies of all documents EAD, receipt notices, approval notices made.

I have 140 and 485 applications pending, the 140 application is based off of EB3 professional workers category.Country of citizenship : India. Since EB3 unskilled is at Mar 15 2003, Is there a way I can request a switch/consideration to that category with the pending 140/485 apps? My PD is Jan 2003
