Topic: Just called TSC today!

You should get approved anytime between 30-45 days. I had same experience and my I-485 was approved in 20 days from the day it was assigned to an officer. However, it still depends on officer and number of cases s/he has on his desk.

But I am sure you will receive some good news soon.

Try POJ method to speak to an IO at TSC. even if you call, you wont get any positive response about your case because you are still within the processing Window. It appears that you applied for I-140 in July but TSC is working on June 2007 cases now. You can raise a SR when processing dates+30 days past since you had applied.

If you look at SOP for I-485, once the applicant clears FP and NC, the file is pulled out and sent to workload distribution area. This is where the files are assigned to Adjucating officers when they ask for work orders. An IO may get 100s of cases at single time (may be more or less). If everything is OK with the file and visa being current for country of chargeability/country, IO recommends for visa approval from DOS. If you read thro SOP for I-485 it is very clear.

You need to use POJ method to reach an IO at TSC/NSC. Call USCIS at 1800.375.5283 and then press 1,2,2,6,1, enter ur Receipt No, wait for automated message, then press 1, 3, 4...Now wait in the queue to speak an IO.

NSC is working on April I-485 applications now. But if you the see approval trend, it is not always same as compared to the published processing times. My I-140 was approved TSC and now I-485 is at NSC. The IO at NSC emailed her supervisor becasue my FP and NC were cleared (and also because I mentioned to her that my category is current). Wha she said was true and my file has already been assigned to an officer.

Folks:

Previous story:
I filed my I-485 in October 2007 based on my EB1-EA I-140 at TSC (India), NC was cleared within a week and FP on Jan 04. A nice told me (Jan 7, 2008) that she would e-mail her supervsior becase my background checks were cleared. Since then I called couple of times using POJ method, heard that mine was aready to be assigned to an officer AND Now IO told me my I-485 is with an officer (confirmed twice).

Today's confusion:

Just spoke to IO at NSC and she told me that there are no visas are available for EB1 india. I mentioned her that EBI India is current. India gets 7% of total visas (140K) is 9800 and 28.6 % 9800 (for EB1) is around 2800. that is 700 /quarter or 233.33per month.

My understanding is that USCIS approves only 233 for EB1 (or EB2, for India or other retrogressed countries) per month. But if we see EB2 India scenerio recently, USICS did not follow any rules in approving case either monthly or Quarterly.

Guys- can you shed some light on this issue.

You better call USCIS using POJ method and ask the IIO's. I could found about my NC thro POJ method only and called three other times to confirm, most of the time I waited for 5 mins on phone line.

Yes. You are right. My RD is 9th Nov and my FP appointment is on 3Jan 2008. I called NSC few times but was told the FP appointment is depending on local ASC centres only. Nothing to do with TSC/NSC unless they forgot to request the ASC one.

Why did u appyl under EB3 when your EB1-C is pending. Is it not contradictory, you could have done under EB2 when you were elibigle to apply for EB1-C.

Can you explain about this as this may help others.

I did have LUD yesterday and an e-mail from CRIS saying that My I-140 was approved. my I-140 was approved way back in Oct 15 and TSC updated my file as seen from LUD on 12/02 and CRIS e-mail.

I think there is some batch update. it could be a good sign for the people who are waiting.

If you or family want Visa stamping in India then you need also file a petition called -Application for an action on an approved petition (-I-814 or dont know exact number of form) to USCIS. So that USCIS notifies the respective consulate where you will go for stamping. If you dont this might delay back in India

Is FBI name check is run to see if the applicant has any criminal record. How do you know that if you work in specialist area, you are further subjected to other kinds of check. Does USCIS ask FBI do that?

Can you shed some light on this. But I could see lot of EB1 from India are waiting in the queue (as per trackitt). Dont know why USCIS is treating like us though visas are current and we are priority workers?

Visa numbers are allocated either on monthly or quarterly basis. So if they are used up , then one has to wait until it becomes available.

My I-140 RD is 6th June 2007 and approved on 15th October 2007 under EB1-EA. 6-month time line is approximate timeline, one can get approved between 3.5 to 7 months at TSC.
