No you don't, provided you have valid visa h1 or h4 in your pp before leaving US.
I travelled with my wife and kids on Kuwait Airways in June 08. With change of terminal in heathrow for clean up/ fueling, we had to walk a very long distance in the concourse, but no problems.We did not have transit visa. |

If you have valid h1 stamp in your PP,you don't need AP at all.I had AP with me, but I did not show it, was admitted back on hib. Afterwards I asked the officer should I show him the AP he said no need, and it had no impact on my pending I-485 at that time. I entered with my family on June 18'08 and my GC was approved 43 days later on 8/1/08. |

There should be no confusion.
Either u should have valid H1b visa stamp in your passport when you re enter USA or you must have an approved AP BEFORE you leave USA, or else your I-485 will be considered abandoned.
As far as the processing or potential of approval in 09/08, even GOD won't predict chances with USCIS- what they will or won't do. |

I had LUDs on my approved AP and EAD and pending 485 from 7/07 on 7/29/08 and I did get the magic mails on 8/1/8 and the plastics on 8/8/8.
So I think you all have things really cooking and I think it is happening for you in the coming few days ahead.

yes Idid.
I had 2 A#s.The one I got on my GC was different than the one I had during the I-140 processing stage.
In fact I had put the A# in my 485 application, but when the receipt I797 came it was another A#, and that 2nd one stayed for the GC.
Also, when I filed a duplicate I-485 that I-797 came with the A# in the I-140 stage, and that I 485 is still pending at TSC, from where my GC was approved, so obviously it is not a problem as far my case was concerned. |

I,my wife and son recieved the physical GCs in mail 15 minutes ago.
Details
EB2 India PD 8/19/05, wrongly entered in I 140 approval as 9/30/05. USCIS till date not corrected it, who cares anymore?!
I-485 RD 7/2/07 one LUD after FP in 9/17/07 then on 7/29/08
CPO e-mail 8/1/08 and softLUD 8/1,3/08
8/4- LUD Notice welcoming new PR,8/5-Approval Notice sent e-mail, soft LUD 8/6
8/8/8- Actual cards recieved.
btw, I have a 2nd I 485 for all of us also in TSC filed on 8/16/07 by myself when I did not see reciepts for 7/2 filings by attorney during the July fiasco. Many people warned me that it will delay our GC and will cause RFEs ,but nothing happened.
I knew that my wife's and my sons NC were cleared 4-5 months ago,but mine was pending.Do not know whether mine was cleared or I am a beneficiary of the 180 day rule.

TSC IO says she does not see my case approved yet in their system.
I got CPO e-mail twice on 8/1/08 ,LUDS on 8/3,8/4 and 8/5, with 8/4 hard LUD stating welcome notice to new PR sent as well as CRIS email for that.
I have FP scheduled earlier for my efiled EAD at ASC today.IO says go for the FP as I have not received any hard copy evidence in my hand that I am approved. |
