be very careful....as a lot of the cases are going in labor audit....mine did and it took 1 1/2 yrs for audit to clear....

you should be able to use ur pririty date as you have an approved I140. You will also be eligible for 3yr H1B extension beyond 6 yrs based on approved I140

Topic: No Initial Assessment or Transferred to local after 27th Feb

Guys, No case has been moved into initial assessment or trans. to local after 27th Feb. Although the new rule applies to those for whom the application was received after 27th Feb but I was wondering if the definition of application recieved is the AOR date. In my case, the filed was received in early January but the AOR is mid March.

Any thoughts???

Topic: EB2 or EB3 - risk of audit

as much as i would like to think it is an EB2 case it is really an EB3.

Reason: It does not matter what your qualification is...what matters is the MINIMUM qualification which would qualify a person to do this job....In this case it is BS + 4 years. They are particularly strict about this and I would not take any risk....this is the first thing they will look in the labor cert. application to put it in EB2 or 3 bucket

You may ask your employers to change the description to BS+5....that would qualify it to be an EB2...

I think this was from the Vancouver conference....its unfortunate to see PERM taking the shape of old labor cert. process. With the India china movement those who have the priority date current are really suffering....

your local police station will just take the finger prints for you. YOu have to send that card to FBI as given in the buffolo package and FBI will then send their response back in a few weeks.

So send the finger print card that you got from the police station to the FBI

It took 45 days in my case....and I know a few others, it has been about 45days for applications filed in 2008.

Topic: Buffalo : Notarized Photocopies

I'm not sure how certify is different than notarize. Anyway they will put there notary stamp on your certified documents. If you are making a copy of certificates, have them write on it "Certified to be a TRUE copy" that way they are certifying your docs to be an exact copy of an original document. Make sure they put the notary stamp, sign and put their notary expiration date. Hope this helps....

Check you local library, at times they have notary public who would notarize documents for free. Otherwise you could also check with your bank, they always have a notary on staff. If one branch refuses, check other branch because at times they may say that only bank documents can be notarized.

Audit response sent on November 7th....havent heard anything....case still pending.
