It will be close to impossible for congress to veto the rule as that requires a 2/3 rd majority.

A more likely scenario is that someone will challenge it in court (Boehner has promised to sue Obama for any immigration fixes). The court can delay the implementation of the rule till the legal proceedings end. If the court strikes a rule then it cannot be implemented.

Given the current makeup of the court, I think the rule has a good chance to be approved and deemed legal.

Things are much better, but still not back to normal. I am in India and have limited internet connectivity. Would really appreciate it if you can catch me up on what has been happening with this rule-change? Have they opened it up for comments?

I checked on www.reginfo.gov and it seems that the rule is still under review with OIRA/OMB, so it seems a bit strange that they would open up the rule-change for public comments without getting the OIRA/OMB approval.

I had received the same response from them. The NPRM hasb een under review by OIRA which comes under OMB. It has been in review with them for over a year now (Submitted 12/06/2012). OIRA looks through the passed laws and verifies that a proposed rule does not violate the law.

No, there is no other organization apart from us who is fighting for this rule. Its upto us to keep the issue alive and keep sending mails like you have. Our best bet is to get a senator to inquire OMB/OIRA why the review is taking so long.

Please try contacting your senator/representative regarding this.

I think its a good thing that there are two separate tracks which have proposed solutions for this problem. Immigration reform is very dicey due to the elections next year. Whereas this fix can be passed without any impunity by Obama as he has no further elections to participate in, however this wont be permanent and can be revoked if both Senate and House deem the rule change unconstitutional.

The political climate will definitely have an impact on when the rule-change will get approved, so if immigration reform again becomes hot then it might put the rule-change on the back burner or President might expedite it to put more pressure on House republicans to pass some reform. I think its too early to guess either way.

Just to clarify one thing though, the language in immigration reform was changed to give the DHS secretary the discretion on which section of H4 dependents will be given the EAD instead of the reciprocal benefit you mentioned. So, it should still positively impact the nationals of India and China.

I think we should keep bringing our issues to the forefront by contacting Senators/representatives. I was reading an article yesterday where Pelosi has publicly requested President Obama to look into stopping/reducing the number of deportations. This is obviously because undocumented immigrants have kept their issue alive by fasting and visiting the offices of their senators. Unfortunately we do not have the same kind of grassroots movement, but we can atleast try to contact them via phone/emails or take a day off and go meet them personally to keep this a priority....

That summary is only about the Legislative agenda of the Congress and does not cover any Admin fixes made/considered by Oabma administration like DACA or this NPRM.

However the summary does mention that both the House and Senate bill grant work permits to H4 spouses so its kind of mentioned in there.

This blog was posted here a few weeks ago as well and its completely rubbish!! Firstly, go and read the actual NPRM text. It is only applicable to people who have already started the GC process and not all H4's. So not all H4's will be eligible to get the EAD every year, that pretty much refutes all your points, like 130000 Jobs annually. The person who wrote this blog does not know any thing about the proposed rule or even how H1B visa works.

I would like to also add that when you have to start making arguments like "There would be huge demand to get married to H1B visa..." you have already lost all credibility to conduct any reasonable discussion. Whoever wrote this is a troll and nothing more.

If you actually go and read the comments in the blog link you will see that people have already provided arguments refuting all the points.

Couple of very small positive developments for this rule-change:

Obama nominees for DHS Secretary and Deputy Secretary have progressed in their confirmation process. Jeh Johnson might be approved on Monday, while the deputy secretary might also be approved before Senate goes into recess later this year.

It will have to be revoted as this will be a completely new congress. The link you are referring to talks about a bill in the same congress. However in the US a new congress convenes every two years. And a new congress cannot take up a bill that the previous congress was working on. See: http://thomas.loc.gov/home/faqlist.html#7

For all practical purposes If a bill does not pass before elections they will have to restart the entire process, which means reintroducing the bill in various committees and then going through CBO etc before it can be voted on. So if the 113th congress does not vote on this bill we will have to redo all the work that Senate has completed.

I can give you several reasons why the immigration system is broken, but the main one being that in every other law of the land US government wants to prevent exploitation and discrimination, but the current immigration laws actually make both documented and undocumented immigrants ripe for exploitation and the laws themselves had some discrimination built into them.

I have done my research, I have spoken to 2 immigration lawyers (who are active in reform activities) who have told me that senior officials at USCIS believe the NPRM in its current from is good policy (it was even reported by AILA). You can go and read the response from Felicia Escobar(Senior Policy Advisor) and see that to a large extent Obama administration also agrees that this rule-change will be good policy. My conclusion from all of this research is that most people agree this rule-change is required, however it has been continuously delayed because of the politics and because they do not have any incentive to expedite it unlike DACA. Few other events like sequestration have also conspired against us.

As for my activity, I have been participating in this forum since early April and in immigration reform work since late last year. By now I have sent several hundred emails and 27 letters. I have called the senators/representatives once every week since August. Most times I have gotten a canned response, but I have not given up and my point still stands, if you have a new idea about how to bring about change then do share. If not then either help by whatever means you can or if you have lost hope or are unwilling to help then please ignore us.

You know what I have refrained from replying to people like you who think they know it all. What makes you think I and others on this forum are only waiting for this? Did it cross your mind that maybe we are looking at all possible avenues to help fix the broken immigration system. If you have a suggestion about what "other option" we should look into please do share.

If you do not have anything to contribute then get out of the way and let us do our thing even if it seems futile to you.

That was expected as this was more about PR than answering tough questions. Our best bet is to keep making noise about the issue, like the other immigration groups so that our side also get addressed. Look at how active some of the folks requesting reform for undocumented immigrants are. Check out the twitter profiles for Fast4Families etc.

We obviously cannot give up our jobs and lives to make our case but lets at least try and keep sending emails to our representatives, contact them via phone or go and meet them in person to tell our story!!

I would like to ask the white house why no progress has been made on the reforms that were proposed for legal immigration by the administration? For example DHS proposed a rule change to give employment authorization to H4 dependents who have already applied for a green card and have been legally present in the US for 6 years. However this proposed fix has been pending for over 2 years now with the Office of Information and Regulation affairs.
