Topic: AC21 485 denied what to do?

I think you're getting close to the wires as far as AC21 rules.. You said I-140 was approved on Aug and you've already files AC21 on Sept. USCIS might want to drag you in papers and courts to prove that you did not intend to leave the company when the I-140 was pending. If you cannot prove that, it deems your I-140 to auto-revokes and therefor your I-485 is dooms as well. I am sorry I am not optimistic like the other posters, USCIS is not an easy agency to deal with (anyone met an agency that is?!)

Topic: October 2008 - Makes sense to approve all pending current applications!

It's not that they want to waste it, they HAVE TO! If they actually use all the VISA, this would mean that one department of the federal government is actually working well... This can open a split in space-time that might end life as we know it.

In the applications explain what do you need. And of course you have to submit supporting documents.



This information is not correct. I have called today to TX and the IO told me that e-file for I-765 does not require any supporting document. If any document will be needed, RFE will be issued.

Some background, I've moved and filed AR11 last week. My PD is not current under March VB. Today I saw a LUD change (still say pending) for both me an my wife (with today date) I-485. Is it normal to see LUD after filing AR11?!

OK, I'll try to explain better.

According to the PERM statistics, there are about 50% that their LC got approved with Master degree or higher education. Now, those persons, with their depended would be falling under EB2 or EB1 (if I understand correctly, they don't have the EB3 option). So that leaves us with the other %50. EB3 does require batchler degree, or equivalent, as only %29.8 of approved LC are for a batchlur degree, I would assume that over all there would be %30 as EB3 (general) and %10 EB2 (as expirence can be considered Master), 3-5% EB1 (can hold a company or something), 5% EB3 other workers. So EB3 should be about %30 of to total LC.

Now, if you'll look at the country statistics, you can extract that 45% of the total number comes from a retrogressed countries, so the adjutment from total to ROW should be 55% (although there is no statistics for the EB3 in specific, but this is as close as you get).

Now about the "building the backlog at the rate of about 25 - 30k per year" - You need to look at ROW applicant to establish that. As far as I can understand it, India and the already heavily retrogressed countries are building a backlog, not sure if that's the case for ROW, and if it is, I am not sure that it is in this rate.

But seriously, I've just placed the numbers extracted from the PERM statistics. This should be a good indication of the case variety on the USCIS table, so if you used the PERM as a base to the I-485, which everyone since 2005 did, this should give you a good indication...

Actually, this is a great place to post it. This is great news for EB3 ROW, this means that the calculations of EB3 should be done with certain percentages:

ROW adjustment should be 55% from the total number of pending cases
EB3 are 30%

This means, that if the total number of case pending with USCIS (I-485) is 833,141 (based on 12/31 numbers), so EB3 ROW are only 137,468. This means that with the current trend of DOS to *try* and avoid wasting GC (last year and apparently this year), we should expect the cut-off dates for EB3 ROW to be 2006/2007 by the end of the next fiscal year (if not sooner). This is my prediction.
