Topic: Unused visa numbers
For the fiscal year of 2007, EB3 India moved from Apr 01 to Nov 01 (disregarding the June/July 07 fiasco). If this trend continues next year , EB3 might move to June 02 by Oct 09 which does not bode well for EB3 India applicants. This is espcially when any leftovers from EB2 and EB1 row would be used up by other EB2 quotas. |

This would mean that if EB3 India had exhausted all it's visa numbers (roughly 2900+) and is unavailable (U) for the year, we would have to first see EB2 India as being current ("C") before EB3 India becomes available for certain priority dates. Am I right ? |

Can someone shed some light on how do the ROW unused visa numbers get allocated to various categories for countries like India/China/Phillipines/Mexico ? eg. if there are 10,000 unused numbers in EB1 and EB2 ROW, do they all first get allocated to EB2 India/China/Phillpines/Mexico ? And only if there are further leftovers from EB2 do they get further passed on the EB3 India/China...? OR do they get divided btw EB2 and EB3 to begin with ?

You can apply for dependent I-485 as long as your priority date is current and your I-485 is not approved. Once it is approved and you get your GC, it may be too late. Although, i have heard of Follow to Join option, which you can use after getting your GC (only if you were married before the GC approval), but am not too clear on that. |

I know you did ask for lawyers in the NY area. Eventhough, the well known lawyers like Sheela Murthy, Shusterman etc may be outside of NY, they may have local offices. Plus everything is taken care thru emails and phones etc. You may not even need to hire any of them. You can just schedule an appointment with any of them (you do have to pay for that) and then get answers to all your questions. I myself have no experience with any of these famous lawyers but have friends who have hired them. |

If you call the service center using the POJ method and if you are lucky enough to get thru a IO who is willing to share some info, you can find out from him if the name check is done or not.

After responding to the RFE the status changed to "Response to RFE received and case processing has resumed". I had a few soft LUDs after that but the status remained unchanged since then. |
Topic: Receipt numbers
One way to check is asking your lawyer if the check has been cleared for these applications. If the check has been cleared and if the check comes back to him, sometimes it may have a receipt number at the back of it or as a reference somewhere. Also, you can ask him for the postal/courier receipt. |
