Topic: Urgent EAD, AP question!!!!!!!!!!!!!!!!!!!!!!!

My priority date is now current. I know that there is no guarantee that I will get my green card soon. I plan to apply for an EAD and AP extension for my husband, who is on F-1. However I would like to defer the application till end of September. His EAD and AP expire on 27th October 2008. His I-20 is valid till 2011 and he has not traveled out of the country since we applied for our 485.

Will his status be illegal under the following scenario?
1) I apply for extension on 30th Sept.
2) We do not receive our green card till 27th Oct.
3) The AP and EAD do not arrive till 27th Oct
4) In case I cannot apply for extension online and we do not get a receipt for the application.

Topic: Should we apply for EAD & AP extension for somebody on F-1?

My spouse is on F-1. We applied for his 485 when my employer did my application for the same. This was during the July 07 fiasco. The lawyer had applied for EAD and AP also. Now the EAD and AP are up for renewal in the end of Oct. But in the August bulletin we are current.
PD 09/22/2004.
We have no plan to travel and we have not used our respective EADs and he has never used his AP.
Since the cost of renewal of pretty high for both, I want to know if there is any necessity to do so? I know it is not required in my case since I have a valid H1-B but what about my spouse?

Is this the date on the USCIS website? On the USCIS web site I can only see the date. I've noticed people quoting time stamps too.

Topic: What is the order in which the cases are being approved?

Are the cases being addressed based on the case receipt date or on the priority date. I cannot make out looking at the data.
My PD is Sept 2004 and receipt date is 09/27/2007.

Topic: What options does an EAD give me?

I will soon be on my 8th year of H1. This time my employer has decided to extend my h1. But in case they hadn't and I was forced to use my EAD then could I also work on a part time job? Is there some law that says that my employer will have to keep on extending my h1B till my green card is approved?

Topic: Problems with filing I-140

I have been working as an IT professional for 10+ years, 4 years in India and rest in the US. When I joined the current company I had 4+ years experience. When my labor was filed I had already worked for the company for 3+ years. So the total years of experience when the labor was filed was 7+ years. My lawyer had filed my petition in the EB2 category. The labor was approved. But now he has come back to me and says that I do not have enough experience to file under EB2. He says he will still file under EB2, but the chances are that my I-140 will get rejected are high.

Topic: How long does it take to receive the paper work once I see I'm certified online?

I've received conflicting reports. When I called the DOL, they said the turn around time is 3 months.
