Interview Status:clearedInterview Experience:The interview letter came in mail 3 months after transfer to NBC..first of all,my wife got her’s but I didn’t and I was very worried,why and I’m primary..5 days passed until I got my interview notice,they were dated the same dates and were mailed the same day but why she got it 5 days before mine,nobody knows.. Then the big shock came in a week later,when we got interview cancellation notices..we were shocked,disappointed and very sad…why??More wait and delays..then couple weeks later we got a new interview notice..it was 5 months after transfer to NBC… I started gathering the documents for the interview…tons of papers and copies..reading the transfer to National Benefits Center thread on Trackitt made me obsessed..I gathered documents days and nights..a bag of 15 lbs full of papers.. We went to the interview on a very cold day…the officer who interviewed us asked us to say the oath and sign attorney waiver paper..we didn’t take attorney with us ,I knew that my case in straightforward and no need for attorney..the officer was very nice and the only question I was asked about was how come that I live in city X and I work in city Y and they are 4 hours away..I explained that happened because of change of address mess,she asked for employment verification letter and she updated our I-485 informations and asked the yes and no questions on it..then she collected I-94s and she shocked us by saying”I’m not specialized in employment based,if we need something from you e will send you a RFE,if not we will approve the case”… I was very disappointed because I didn’t get the approval right away,but what we can do…2 weeks later,we got”Card Production Order”..

Hold on for couple days..you will see approval all of a sudden..in my case no LUDs after the interview...few days later I got approval..Don't worry,you will get ..reeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeelax

Yes, a handful of EB applicants are interviewed every year - this is the "random" pool of interviews in reason 1 :)

Maybe you misunderstood - when I list the reasons, it does not mean that everyone in that situation will be selected for interview, it just may be a reason for interview. So for example, in reason #2, where I mention AC21 - not EVERYONE with AC21 will be interviewed, but someone who has done AC21 and gets an interview may get an interview letter requesting him/her to bring all the AC21-involved paperwork to the interview.

In our case, our interview letter requested nothing but things related to proving our marriage, and that is what the whole interview was about.

In other people's cases (people I have seen on trackitt and other friends who went through this), the other reasons have surfaced.

All info comes from personal experience, friend's experiences or from my lawyer...

Have you received the approval notice yet..We are in the same boat,your case is similar to mine..I was approved after the interview and I got welocme notice and the card,but no approval notice,,the attorney told me that welcome notice is the approval notice...

Why that? Card production order was 6 weeks ago and I received the card...Today,I got hard LUD says"approval notice sent"..it was dated 5 weeks ago(February 3rd)but I got it yesterday..does it mean that I will receive the approval notice(which I never received)in the next few days?

you are so obsessed guys...your employer who sponsored your green card has the right to ask you for that...If you decide not to do it your employer can be very upset and can revoke your I-140 and then you will be in deep sh*t...

For EVL, the thing is that I am working with the same employer since 2004. Do I still need and EVL saying that my employer intends to give me same position and salary as mentioned in the LC. The fact is that I am already holding the same position and earning slightly higher salary than the prevailing wage.

I have gone thru the list of documents indicated on my interview letter but I got confused where it says "Birth certificate and proof of citizenship of the petitioner". This can only be true for relative-based I-485.

Topic: Questions on upcoming USCIS Interview


I and my wife have our EB based AOS interview with USCIS next month. We both are currently working on H1B and I am the primary. I have a few questions that I am hoping to find answers to here.

1. Do I need to bring original LCAs from all the times I applied H1B petitions ( I extended twice). Does my wife also needs to get LCA from her H1B petition?

2. The interview notice asks for Affidavit of Support I-864. Do I (primary) need to get this from my employer while my wife (derivative) needs this from me?

3. Do I need to get my employer's proof of US citizenship/permanent residence ( The letter says to get sponsor's citizenship/PR doc.)?

4. Do I need to get my employer's birth certificate (The letter says to get petitioner's birth cert)?.

5. Do I need to get wife's (derivative) employer's tax returns too ( in addition to my employers returns)?

Hi Guys, I have a question, my case was transfered to NBC on feb 10, got soft Lud on feb 11, since then nothing, I haven't recieved any message such your case is pending in NBC. Is that normal? I thought i will recieve a confirmation that NBC got my case, should I be worried?

Don't worry..in my case...I got the "case pending at NBC" after 45 days of transfer..my wife never got that update...both of us received the interview letter at the same day...so don't rely on those updates...

Again, since the same subject is being discussed in these two threads, I will just paste the same reply of mine here as well:

No one is implying that you change the law on your own or that you are defying it with the intent of breaking it. Every law has a letter and a spirit. The letter of the law says you have to carry it with you at all times. Does that mean you have to have it on your person at ALL times? Even when you are sleeping, taking a shower, scuba diving or even skydiving?

The spirit of the law says you have it with you (or be able to produce it on demand) so that you may prove that you are in the US legally, and secondly to prove that you are a lawful permanent resident.

If you hand over a copy of the GC which you had on your person when you are asked to prove your legal status here in the US, you are just using common sense. Try to console the guy who lost his GC and now will have to go through a useless cycle of forms and fees and heartache to replace the card. And on top of that, if someone were to use that lost or stolen card to conduct an illegal transaction, can you imagine how much trouble the genuine owner can be in? Even if he has a police report that the card was lost or stolen? Just ask anyone who has had their identity stolen, how long it takes to get everything back in order, sometimes months and sometimes the troubles never go away.

If all laws were to be followed to the letter there would only be a legislative body that makes and passes laws but no judiciary to interpret those laws' spirit.
