For those interested in my case, I had my interview yesterday (06/22/2009) and was approved. I got my passport stamped and CRIS has send me "card production ordered" email. I will let you know when I actual do receive my Greencard.

Even if you do not have enough imcome you still have to be the main sponsor and make his brother the joint sponsor, so you have to fill out the I-864 form and your husband's brother will fill out I-864A to become a joint sponsor. That is how will filed ours. | |  |  |

I am just glad to finally see some movement on we the Oct filers, I seem for a minute that USCIS forgot of us. I wish everybody continued sustained progress and hopefully we will get out interview letters next week.
Mabsquare: what is the situation with you ombudsman intervention, did USCIS get back to you? I beleieve it is about a week now since you received your reply from the Ombudsman. | |  |  |

Topic: CRIS's Friendship and Question on Case Status
For those of you who have been following my case I have an Update for you. CRIS is trying to be my friend now after months of inactivity. I got two mails from him on 03/09 one telling me that my EAD card has been ordered and the other that my AP has been approved. The next day 03/10 he sent me a second email stating that my AP has been approve and simultaneously updated my I-485 to “Response to request for evidence received, and case processing has resumedâ€. The two days later 03/12 I had another email stating again that my EAD card has been ordered.
Anybody who know CRIS should tell him that I am not impressed, that he needs to do more than that to become my friend…..lol First of all need for him to generate my interview letter as soon as possible, then I can even consider being friends with him.
My question is to those of you fortunate enough to get updates on you cases:
what does the “Current Status†on the USCIS say when you interview letters are sent???? | |  |  |

Man, take heart, there are no marriage that do not have problems. I hope and pray that you and you wife reconcile issues and get abck together. In the mean time keep us posted with Ombusman experience. If we have favorable experience probably we can start a thread that will advice others on how to use the that route to get their EADs quick. | |  |  |

Finally there is moment on my case; CRIS has just informed me that my EAD card has been ordered and that my AP approval notice has been sent. This comes on the heels of my lawyer writing to the PublicAffairs CISOmbudsman to complain that my EAD card is passed the 90 day timelimit set by USCIS and that we contacted USCIS and they did not get out the EAD car.
Apprenetly, the PublicAffairs CISOmbudsman has leverage over USCIS when it comes to the issuance of EADs, especially if it is passed the 90 timelimit. The PublicAffairs CISOmbudsman took our case last week and told us to expect a reply from USCIS in 7 days and surely USCIS responded with CRIS’s email that I received today.
For those of the Oct filers still waiting for your EADs I will recommend that you try the CISOmbudsman Just give them your case #, alien # and tell them that you the 90 days timelimit for your EAD application is over and you contacted USCIS but you did not get your EADs yet.

I receievd another RFE and that is after I had put in a service request to USCIS that my EAD is passed the normal 90 day processing time. I mam tired of getting angry with USCIS so I will just say what they want and let someone else get angry for me.
1. This time the RFE wants me to send a copy of my Marriage certificate which I already, I don't know why we pay them all this money when they will not even take take their time to look through documents that we present to them.
2. USCIS claim that my income for the Affidavit off Support was not enough so I should either find a joint sponsor or provide addition document to proof income.
Well, in reply to the RFE I have just sent the Marriage certificate again and my 2008 tax returns and my w2 which show an income way above the 125% poverty (whatsoever).
Well, my RFE is off today and my wait for my EAD has reset to 90 from the receipt of it. As for my final interview I can only dream of it for now. | |  |  |

USCIS is not worried whether your husband is working or not. They are only worried that you do end up taking public funds when you are grant your residency, that is why they want you to provide them an 'Affidavit of Support'. You do not have to necessarily use your husband for the affidavit you can find a co-sponsor.
Here is the detail piece from the USCIS regarding co-sponsorship:
"Who can be a joint sponsor, and when is a joint sponsor allowed?
If the visa petitioner's household income is not sufficient to meet the requirements of INA section 213A and 8 CFR section 213a, INA section 213A permits a joint sponsor to sign an affidavit of support, in addition to the affidavit of support signed by the visa petitioner. A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125 percent income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement." | |  |  |

Does anybody have an idea as to how long it takes USCIS to respond to a service request?
