Topic: I-485 Pending, Intial Interview already received

Pinki...have you heard anything from USCIS? My husband received his 2nd Biometrics appointment a couple weeks ago stating that his original biometrics have already expired (taken back in Nov 2008). I don't understand why it works that way...fingerprints do not change overtime...I wonder if it is only a delaying tactic on USCIS' part...and I don't know why his case is taking forever. We have 4 kids...and both of us have clean background records....only reason I could think of that is delaying his case is his name being a very common Hispanic name....other than that, nothing else. Do you know why your case has not been decided yet? We had our interview sometime July last year...which took less than 10 minutes...IO said everything looks fine and we need not worry (more than enough proof of bonafide marriage - 4 kids)...and that we should just wait for her decision in the mail...which to date, never came...i also wonder if divorce might affect the case...hubby was married to a USC but their marriage didn't last...USC spouse cheated on him and took off with some guy...no case was ever filed with USCIS....

Hi Jenjudd2. Since your husband came here illegally, his only way to be legalized is having to do a consular processing. What this means is he would have to go back to his country to wait for his visa. However, since he has been here for more than a year, he is subject to the harsh 10 year bar from the US. The only way to battle this 10 year bar is the EXTREME HARDSHIP waiver. He has to prove that the denial of his case will result in extreme hardship on your part as a spouse and your child. Proving this is not easy though. I suggest you hire a very good lawyer to do this.

Also, if he had any form of petition (family I-130 petition by U.S. citizen or legal resident relative, ora labor certification or employment petition filed for them by an employer offering a permanent job filed) filed on his behalf before April 30, 2001, then he wouldn't have to leave the country. This is the 245i law.

Case pending...interview was back in july 09...no updates online...until we received this appointment notice in the mail today for my spouse to appear for 2nd finger printing next week...anyone ever been through this? is this normal? what does this mean?

Per notice, fingerprint card on file has expired. In order for USCIS to continue processing application, it will be necessary to have fingerprints re-taken.

Is this something normal? Please advise. thanks

Yes, we did more than 1 infopass appointment..the most recent was just last January (the 6th month since the interview in July)...and yet nothing...everytime we went, all they tell us is that our case is still in review...neither can they stamp your passport...stamping it means your case was approved...which in ours, is still pending for further review...with regards to case status update online, I agree that they are not updated diligently...mine still says initial review...when infact we already had our interview back in July 2009. I know it is so stessful but don't let it affect your daily life....as long as marriage is legit, there is nothing to worry... :) I guess good luck to us with this dag on wait! :)

I have scheduled several Infopasses as well...but same response...and they could not give me more details...whatever they see in their computer is all that they will tell us... :( ...I guess it's their way to squeeze out more money from us... :( my hubby is due to renew his EAD in February which means another $340 for them :(

before they leave, let them adjust their status here...otherwise, they will be banned for several years (depending on country of origin)...since the I130 has already been approved, the I485 shouldn't take long...i suggest that you file the I485 now...they should be green card holders in less than 4 months :)

We are in the same boat...USCIS received our application back in Oct 2008...interview on July 2009...interview went well....didn't even last 10 mins...(our kids were with us at the time of interview and so IO didn't ask for a lot of paperworks)...since interview, didn't hear anything from them...and all i got was case is under review...no status update online either... :(

well in our case, we had our interview back in july 09..IO said she didn't need much paperwork from us since we have kids and that was enough proof of a bonafide marriage...she didn't take my hubby's ead but took his I94....didn't even get any approval on his I130 (which means you're 1 step ahead of us :) )....as of today, didn't hear anything from USCIS...no case update...nothing :(

We had our interview back in July but have not heard anything from immigration since then...per inquiry, case is sent for further review...not sure why...our case is legit and i don't see why there's a need for further review...we have 4 kids and both my spouse and I have clean criminal backrounds...unless of course they had to do a name check...my hubby's name (person adjusting status) is a very common spanish name...

Topic: has anyone had a recent interview in Houston, TX

My husband and I recently had our interview last week. IO didn't say if we were approved or denied on the spot. She asked us basic questions and most of them were directed to my husband. Then the IO asked us whether to give her proofs...i started handing her out documents and as i was trying to look for the copy of our apartment lease, the IO told me that everything I handed her was enough because we have kids (2) and the 3rd one on the way. Interview didn't even take 10 minutes (my 5 daughter was kinda bothering us as well---she had to pee so bad ). Then all the IO said was she had to review the case and that we should get a decision in the mail. It has been more than a week now since the interview but still haven't heard anything from USCIS. Case status online hasn't changed either...still says pending? The IO took my husband's I94 but didn't take his EAD? I thought due to the "delay in card production" that they were stamping passports once the case has been approved...does this mean our case was denied? Any enlightenment is greatly appreciated. thanks

Creativecakes: I didn't hire an attorney because they are really expensive....Everything is self explanatory...all documents needed are well explained.. Mine only took forever, because they sent me a request for additional evidence (for the 2008 income tax return) but I never received the letter (I guess it was my mailman's fault)....and I was told that USCIS will never make a second attempt unless you request. I believe your husband will not have any problems coming to the US coming from Cayman Island---try to check on this because my friend came from Cayman Island and was able to cross to the US without any problem (she wasn't a US citizen/immigrant). If he was here, the forms you would be needing are I485, I130, I864, I765, I131(if you have any plans of going out of the country while his case is pending). All in all, without a lawyer, this would cost around $1,500 ($1010 + $355)......

hi mamaa...it's nice to know that you finally have your IL....My husband just got an update online saying "card production ordered" --this is for his I765. It sucks right....it took this long for him to get his working authorization despite many attempts to contact the ombudsman and the USCIS. The problem with ours is the I864 that we submitted back in December. It was showing the GRT (gross receipt tax) of our co-sponsor, not his net income tax (as he is self employed). According to USCIS, they sent us a Request for Additional evidence but we never received that...Neither was there any status update on my husband's case online. Had they updated the status online, we would have known then (back in December) that there was something missing and we would have know to get a service request for his I485 (which is where the I864 is attached). We only found out that there was a document missing in April, this was after we finally got a service request for his I485. After submitting those documents, we had a status update on his I485 saying RFE was received and case processing has been resumed. Then a few days later was an update on his I765 saying "card production ordered"....still hangin in here....looks like you are almost seeing the light at the end of the tunnel....i'm just glad that there is finally a movement for us...

Topic: All Interview Experiences Posted Here...

Hi. To those experiencing a delay in receiving their cards from (Lee Summit, MO): I read a post also here in trackitt saying that the delay in card production is caused by a new machinery for producing cards is being installed there...(that is according to one of trackitt's member's lawyer) so I guess that probably explains why? Not sure though...just read it from someone's post.... :)
