Topic: Off topic... Any economist out there...

A quick note, when cutting costs, firms cut employment too deep causing productivity per employee to increase. Simply speaking more work for same (or less sometimes) pay, which "burns" people - how long can you work extended hours, handlign much more work than before? Do you think you'll have time to reflect and come up with brilliant ideas?

Now, if people work at their limit or even over, then very soon we'll have to make a choice: as employee - is this a new normal and I need to work twice as hard and I better get used to it, give up my personal life or else (my own business, different job, differet career path, etc.)? and as employers - can I squeeze extra productivity from the existing workforce or do I need to plan to hire soon as my inventory got depleted and demand inches higher?

Economists, in general, expect 2010 to be tough as far as employement is concerned and most them don't expect any significant improvements until 3 years from now, maybe longer. But the economist got it wrong again, I think, the only way we can get out of this mess is if we work smarter not longer. It's tough as it is - how much tougher you can handle?

My A2P wasn't an issue, the issue was to point an officer to where the explanation is, literally. If you really have a problem, a complicated case, you need to contact one of the big names like Murthy, Ron Gotcher or an informal guru, like UnitedNations.

My lawyer is no miracle worker, unfortunately.

who was your lawyer. i would appeciate if you could tell me.

A2P wasn't an issue, the issue was that the financial docs were provided by a parent company and the officer didn't see documentation that proved relatioships between the two entities. It was easy to overcome.

I'm for a round two in this process, now applying for Eb2 with my new employer, which is Fortune 50, not sure how it's going to work out, given the fact that I have 10 month remaining in my h1b status... I'll run out of options soon...

I really hopeful for this reform. If I read this part correctly:

"6. We must encourage the world’s best and brightest individuals to come to the United States and create the new technologies and businesses that will employ countless American workers, but must discourage businesses from using our immigration laws as a means to obtain temporary and less-expensive foreign labor to replace capable American workers; and finally",

I think that what he means is getting away from temporary H1b visa that depends on employer and move to a permanent status, with strings attached, that is initiated and conducted by an employee him/her-self. The strings attached - it seems that this new process will have to ensure that capable Americna workers are not replaced.... I hope that it does not mean that DOL will supervise it all.... again...

A very fcking unfortunate situation, but one has to live through it. People lived through worse.... The historians are saying that there were times when human population shrunk to a thousand or so.... That was desperate, that was fcking tough and hard and perhaps desperate... What we witness today is just a little wrinkle... Jump over it and keep on going....

it's simple actually - you are out of job :

- start checking online job offerings in India, apply - make this your full time work;
- if you have Advance Parole, in a few weeks or a month, go there for a month or two. If you are lucky, you'll be able to lend some interviews before your arrival;
- stay there for a month, see how you like it there, what kind of opportunities are available, etc.

However, be prepared that the job market sucks, it might be unrealistic to find any job within 2 months, or even land an interview, that might take 6 or more months. Don't lose hope, though, during that time keep on looking for a job across the US and India - see what you can land. Stay positive and open - as soon as you get depressed, desperate, nobody will want to hire you, and you don't want that to happen. In the end of the day, the life is not about money, green card or any of those things. It's a good time to re-evaluate your life, set up new priority to your likings. Not everything is measured in terms of success. The thirst for success at any price got us into this mess in the first place....

Don't run away, don't be scared - you have little to lose anyway. Nobody depends on you. Nobody will judge you. This recession is everywhere for a long time. It's probably a new "business as usual". Do what you think is right.

BUT - on the other side, you have good education, experience, and skills - think of starting your own business. What can it be? World is full of opportunities. And you can take one and make a difference for yourself and for other people around you.

The answers to your questions can't be simple Yes or No. I'm not a lawyer, but as far as I know -

1. the employer needs to sign a request for premium processing.
2. it depends on RFE, for instance, if they request your educational credentials, experience letters, W2, etc. - you can do it yourself, but if they want to confirm Ability to Pay - then you can't do it yourself.
3. some people do get a reply within 15 days, others don't. If you don't get your reply within 15 days, they have to pay back your money.
4. it does not mean you are close to approval, your case can be approved, denied or delayed.
5. it depends - if you have extra 1K and you can't take it any longer, it's worth it - just to buy peace of mind.

I upgraded to premium on 6/30 - hope to get something soon too. Anyway, here is my opinion -

I had an RFE last year for A2P and experience letter, I had the same issue with experience letters, however, I managed to collect the letters. As far as I understand from reading about experience letters - if you can't get the letter from your ex-employer, you need to do/document the following -
- your emails to your ex-employer with their replies (no records);
- try to get letters confirming your experience from your ex-boss, if they work for a different company, then on his/her new company letterhead, if not available, then letters from colleagues;
- if none of the above is available, try to explain it in your reply to RFEs, but that's the worst option and your chance will be slim.

As far as the degree goes - you can contact your university to get that info - they should be able to provide it in English quickly - you might contact the ministry of education in your country. That might sound funny, but it should work - it seemed that this information can be provided on a fairly short notice. I've seen it done really quickly from my home country - which was a big surprise to me.

I'm not an expert, but less than 180 days of illegal presence are not that serious and are normally forgiven if you file eb i-485. today is June, by October first you'll have how much - 4 months of illegal presence? based on what i read, by october 1, priority date for ROW will move to mid 2005 or even 2007, so you'll be current, most likely, and you'll be able to file i-485.

Consult a lawyer, though.

There are quite a few of these "IT researches and innovators" who just can't fcukcing see beyond their nose. And those hypocrits associate themselves with gifted few with which they have nothing in common, apart from their country of origin.
