I'm not an expert -

Only If your employer filed for Chapter 11 Bankruptcy or can prove his financial difficulties are due to genuine reasons like upstream non payment etc.. (if he is been wiring all the money that Client paid to him for the services that you provided - then you have a strong case against your employer), D.O.L. will try to recover the LCA only if the reason for the financial difficulties is valid and real. I know these desi consultants will simply create stories and build their assets outside of US.

My advice is: Before rolling sleeves down on your employer on this Issue - try to find out whether the client paid for your services and try to get a copy of the SOW or payment made by the client, and then negotiate with your employer to amicably settle it instead of legal battles. Try to collect as much evidences and witnesses as possible to defend your case first before you jump against your employer. Find out and group with other colleagues of your's who is on the same boat.

This is a pain man, these guys just play with our professional lives just because they got settled in this country much before us, So Unethical these people are.... Flying down to his place is not advisable with your Hard fought money, think it over and if not working out - find a new employer rather then wasting more money and time with this guy...

Damn, $90K is so huge. Feel sorry for you dude.
